OR Questions

Went bankrupt in Nov 2010, had the OR interview who questioned about two accounts i had with approx £5000.00 pounds which i withdrew before my bankruptcy and gave back to the person who the money belonged to. Explained all of this she asked me to send the evidence and statements which i did long with other information she wanted. Three months later i get another letter from the OR different person this time asking the same questions and evidence replied and told her i had already sent in the evidence along with the other paperwork they reckon they havent got it but they have all the other contents what was in the envelope. This week got a letter saying sorry for taking so long to get back to me but she has been busy with other cases can i can confirm who i gave the money to and there address, already done this three months ago. Yes i know it was stupid to have the £5000.00 but do they seriously think i would have gone bankrupt for £45000.00 and have £5000.00 belonging to me in my bank. The person whos money it is more than happy to confirm with the OR but Im conerned she will have to pay it back when it is there money. Where do they stand. Also somebody told me that they could delay my discharge date is that correct.

    Either:

    a) it was their money that for some reason was in an account in your name.

    or

    b) it was money that you owed this person that you repaid to them prior to bankruptcy.

    a) needs careful explanation and satisfactory reasons.
    b) is not allowed and the OR could easily ask for the money to be paid back as this creditor was given preferential treatment over all your other creditors.

    They can delay discharge until they are satisfied.

    I suspect they may also be considering a BRO/BRU - this is worst case scenario but something that you should be aware of.
