insurance claims

So, some idiot on a cycle can't stop on a hill and runs into the back of my nice new stationary Audi and leaves a big dent. Turns out there's a good chance that my insurers won't be able to recover the loss because he's unlikely to be insured. This of course makes me non too happy. What's the best way to take this forwards, save my excess and my no claims?

Get an estimate for the damage and hand them the bill :-/
if they won't pay take them to small claims court
