    i just want to know 'officially' what they can really do.
    do they have to prove that they made contact with him?
    they say the sent a letter in 1996.
    but if he says he didn't receive it..........how can they prove that he did?

    It would make no difference because as the OP was on benefits then at least some of the money is owed to the secretary of state (at the time you could only keep the first £10 of any maintenance) not to the OP.

    Officially there is nothing YOU can do about this - the claim is on him not you and so it is up to him to ask them to prove that they sent it to an address at which he was living. You can advise him of this but as the CSA has not written to you but to him then they have no remit to discuss the case with you at all.

    If push comes to shove and they are adamant that they won't close it, could you not just give it back to him every month? After the 18 months worth that is owed to the gov? It's disgraceful that they won't listen to the people involved, who the hell do they think they are???:mad:

    I find this incredible - only this week I had a call from them asking me for my 'permission' to move things to the next level in terms of pursuing my ex for maintenance. I call them regularly, my children are very young, it's madness to think I wouldn't want things chased but I just grit my teeth and tell them yes, of course. And then you hear stories like this! They're mad!

    The claim could have been shut after you came off IS, as you didn't get in contact with them the case lay dormant and year after year the arrears grew and now they have caught up with him.

    As CSA-help has already stated he the NRP needs to contact the CSA and ask for his data protection file, this will cost £10 but it should show what address etc they sent the letter to in 1996.

    Seems they are upping their game in the CSA (CMEC) now to claw back as much money for the secretary of state.

    I wish him good luck in proving they had no confident address for him.

    Its good to have a supportive PWC on here when it comes to a incompetant government agency.

    As the others have said tell him to get his file from them and look at the address they sent him notification to. If this address was not the one he lived at at the time then he should be able to prove this and take it from there.

    i spoke to him this morning, and he has got his file, but there is almost no information. no addresses that they said they contacted him at.
    in the meantime they are taking £500 a month, direct from his wages. when he asked how they came to the 42k figure, they said as he didn't supply details, they assessed him without them!
    i worked it out and it is about £100 a week for every week between 1993 and 2001. (i claimed IS between late 1993 and early 1995)
    I never knew there was even a CSA case. when i claimed IS they automaticaaly opened a CSA case, but i never heard anything about it. they never informed me that they were even looking for him, and never asked me for details about him.

    as for the post that suggests i just give the money back to him............i'm not receiving any money! i told them when they phoned that i wasnt interested in chasing him for any arrears.

    i have phoned them myself, but thy refuse to talk to me about it.

    How can that even be possible? If you didn't name him on the CSA forms then they would have reduced your IS at the time, you had to have given them his details. They don't go around randomly picking a name out of a phone book.
