Separation - getting name off mortgage

Please help.

My partner is separated from his wife, and in the process of Divorce (which is going rather stickliy depending on what mood she is in at the time).

The issue is this - their house was in joint name on the mortgage - he wants out of that in order to buy with me. He had offered to give her the whole house in order to get off the mortgage (about 40k mortgage for a house worth 90k not bad deal I think), which was all going swimmingly until now - she has decided NO - for no real reason I can see, she has got a new mortgage all jacked up too - just decided to be awkward I think.

Anyway - is there anything he / we can do about this? Can he get off the mortgage if she is playing silly beggars in this way? Can he get a new mortgage with me whilst still on the old one?

Someone please help, I am a bear of very little brain at the moment! :(

    Luis, if he remains on the mortgage he will also be liable for the same, i.e. any debts - whilst there appears to be equity on the property any mispayments could effect future credit rating. Perhaps wait for happy times and then all systems go to remove his name and any liability.

    It all depends on how much he earns.
    If he has enough income to cover 2 mortgages then there is no problem.

    For most people though it's a problem because they don't have enough income.

    Do you really want to buy a house now?
    There are risks with buying at the moment.
    House prices have peaked and could fall.
    I don't think it would be a bad plan to wait for a while.

    Perhaps he should gradually reduce his offer over time and then she might get the hint that she should snap it up.
