reducing holiday entitlement!

My company that I work for are currently giving us a consultation period as they intend to reduce the number of days holiday that we are entitled to.

Thay made a mistake when changing shift patterns over two years ago and issued too much holiday.

It seems that they will want to issue us with new contracts with the correct amount of holiday.

Where do the employees stand in this position? What if someone refuses to sign such new contract?

    As long as they consult you and give you the minimum 28 days or 5.6 weeks then i think they can get away with it.

    If someone refuses to sign the new contract they will be deemed as resigning. The employer would have to serve the applicable notice (there is no required "consultation period" - just a requirement to consult - so the 28 days mentioned above is not applicable) to anyone refusing and offer them the new contract with all their continuous service intact. If they then still refuse they have resigned. In such a situation the employee may make a tribunal claim for unfair dismissal, but given the circumstances described, I would expect you to loose.

    I would post the old holidays and new proposal for people to get them check, they may have got it wrong again especialy as shifts are involved.

    Oh - good catch. I read it as 28 days or 5.6 weeks consultation! It was a bit early, so the brain obviously hadn't had enough caffeine :)
