Partners ex has appealed - what now?

Yes it does seem unfair. I think child support and tax credits should all be thrown into the equation. She gets her salary, £130 odd child benefit and £500 tax credits a month. My partner is self employed, scratching around for work (he is very lucky if he averages £100 a week at the moment) does not get any child benefit or tax credits and she still wants more than the CSA say he should pay. When things were better for him financially he used to give her £300 a month as a private arrangement but this became more and more unsustainable as work dried up which is why she went to CSA as he could not afford to give her the £300 a month just what he could when he could. He did tell her that if she went to CSA she would get an awful lot less but she just laughed and said that was the chance she was willing to take. As his tax returns have proved he cannot afford the £300 a month and has to pay just over £5 a week. The fact that he paid her £300 a month as private arrangement without going through CSA is mentioned in a solicitors letter somewhere between their two solicitors and she has thrown this into the mix as well to say that that is what he should be paying as it is written in solicitors letter. But it wasn't by court order just what they agreed between themselves when he was in a position to pay that so doubt that will go anywhere.0

if he has submitted his tax returns the CSA will be able to see what is really going on. As for you, as you don't live with him, i don't think you have anything to worry about. It may be worth contacting them yourself and explaining that the ex is angry that you two are together and is trying to cause problems. Similar thing has happened with our PWC so i worte to the CSA and complained, didn't really get me very far but it did stop them asking me questions after receiving clarification from myself.0

Do you think that I will be able to write to them stating that I have paid for various things, continue to do so and that to date he owes me x amount? Yes she is trying to cause problems, she posted a load of lies about me and my partner on facebook, including the one about him hiding money in my account. My partner got a solicitor to look at what she had written for all to see, he decided that it was libelous and harrassment so he sent her a letter stating this to be the case and we would be taking it further if she persisted in doing this. Do you think I should send CSA copy of what she put and copy of solicitors letter that she was sent? Do you think this would help or cause problems?0 -
If you write to them make it clear that you don't live with him, you buy him gifts and send a copy of the letter to them also. i will warn you that as your PWC sounds like ours, it is likely that this behaviour won't stop. I doubt it will cause any more problems than you are already having - she sounds like she doesn't want him to move on - my advice - get used to the way she is, learn her behaviour and do everything you can to protect you and your partner from her. Daft as little things may seem you never know when you may need to use some evidence against her to support you. like facebook screenshots, keep a diary of any inappropriate behaviour etc
Also be careful what you say around the children - you will be amazed at how much a little bit of info is used and exaggerated upon
Our PWC claims she is impoverished ... but i have eveidence to prove otherwise.. just waiting to use it0 -

Make sure that he keeps records of all this. Don't hand cash over - write cheques so that there is a paper trail.0 -
ARGHHH Women are b.it.ch.es!!! I feel at liberty to say this being a woman myself! My partner has not seen his daughter for 3 years due to lies his ex has made up and dragged through court. She also likes to make claims we have more money than we do to try and stall the court proceedings... we qualify for legal aid. CSA comes out of my partners wages automatically every week when he earns enough. We have a child together so he also has to be provided for allowing OH to earn a certain amount before CSA takes any.
We rent a 3 bedroom house and recieve housing benefit only for 2 rooms, ours and our sons... we need 3 bedrooms as his 2 kids from another previous come and stay with us yet we get no extra money for this as we are not in receipt of their child benefit.
When the kids come to stay with us on weekends and longer durin school holidays we provide for them... yet the child benefit/ child tax credits still remain in the bank account of their mother. these benefits are for the children so surely they should go with them. its hard to provide for 2 extra kids wen ur only in receipt of benefit 4 the kid who lives with u. I think the whole system needs looked at for its a joke and extremely outdated!0 -
When the PWC takes this to tribunal make sure your OH attends.
My idiot OH refused to. I showed him what NACSA said, what others experiences on here are etc but no he knew best because the tribunal clark said he didn't have to (true but foolish). PWC had claimed all sorts. I decided not to worry about the alligations of holidays etc because as we haven't had any holidays it would be impossible to show we had ..... or so I thought. When tribunal was finally heard he got a letter to say they had decided he had an extra £600 a month assessable income, I thought this was due to a sizable tax rebate (goes to show never assume - lol) we got several yrs ago but now we have the statement of reasons it is in fact because she SAYS we go sking every year, sunshine holidays twice a year and stay at the hilton every xmas, the judge calculates this must cost £7000 per year therefore he must pay 15% of this to her??? In actual fact in 7 yrs we paid for flights to spain once and stayed at my moms timeshare, we went on a holiday I won and provided evidense of, and some xmas's we go to my moms timeshare which is in the grounds of a hilton hotel but only costs me the elec bill. Luckily for him the assesment she appealled only runs for 3 months before an operation caused a change of circumstanses and therefore a reassement otherwise he would be looking at arrears of about £3,000 all because she thinks I'm rich.
Judge actually states PWC comes accross as a credible and believable witness so we have no reason to disbelieve her verbal claims, this is despite haveing it in writing from NRP that the alledged holidays did not and do not happen.
So if it goes to tribunal MAKE SURE HE GOES. Sorry to shout but I am so very annoyed with OH about this. He now wants to fight the ruling but given that that would mean me doing all the legwork and its actually only caused an extra liability of less than £200 which goes to his daughter anyway I've refused.
Oh and we work in the construction trade too and the judge agrees with the PWC that its odd his tax returns for the last few years are less than 1/2 of what they were 8 years ago - I think these people must have their heads even further in the sand than my stupid OH has:rotfl:0 -
If you say that you paid for things then to be honest, the PWC will lose - if you can prove that you earn money and are suppying whatever lifestyle it is, then that is all that there is to it really. My case was different to yours as I (as PWC) had lots of real evidence against my ex - there is not enough evidence for a tribunal to award in your case as it stands.0

£5 per week officially is a disgrace. Where is he finding the money quoted above? From you? Must be one heelava school trip.0 -
