Im helping my friend at the moment and am trying to get some info please
She went BR in 2008 and ED Feb 2009

One of the debts was a Liability Order by local council who got a suspended posession of her flat and as long as she paid the agreed £5.00 per week she could stay in the flat. OR agreed this £5.00 per week payment as she needed her flat to live in.
She left said flat in Mar 2010 and didnt pay anymore off this debt,,a balance of £305 is owing and the council have set a DCA on her trail.

As she is no longer a tenant of this council and does not need there accommodation does this debt still come under her previous BR and not needed paying?

Also whilst sorting out her papers I came across another DCA who have been chasing her for a Broadband/Dongle/Computer she signed the contract 4 days before she went BR she signed this with Talk Talk Carphone Warehouse..this was not listed as a debt on BR petition is she liable for this or is it included in her petition of said BR

She was in a bad way then and is again now, but is receiving help for her Bipolar Im struggling with these two questions and any help would be most appreciated and gratefully received.

    Hi Annie

    I'm not sure on the first question as the OR agreed she could continue to pay that 'debt' during her BR year.

    For the second question though, ALL debts in existence when she went BR would have been included, even if she forgot to list them. She needs to send off a copy of her BR Order to that DCA advising them she went BR and that they should now contact the OR. If they don't take any notice then Fermi has a lovely 'bog off' letter she can send them. :D

    Thank you for a quick reply and the PM, Im working on the premise that as she has left the flat and does not owe the money and that t it was a proven debt in her BR that the DCA cant enforce it.
    Will send a copy of BR notice to the DCAtand let them faff around , they have backed off when I mentioned that it might have been included in her old BR petition and see how it goes from there.

    Sorry INAN, it was allowed to be paid as she needed a roof over her head she says and was warned that if it wasnt paid they would go back to court and make the suspended posession order against her come into fruition ie chuck her out, so my thoughts are if theres no tenancy theres no debt as it was included in the BR petition so there is no case to answer to DCA and just need to send off her *** of 2008 info to them does that sound reasonable.

    I'm sorry Annie, I really don't know on this one. It seems the rules start getting complicated when the council are involved.

    I'm hoping an experienced member will be able to help you out shortly.
