Hi
I would not pay anything at the moment, unless the CCJ is very new (less than a month).
You need to overturn the CCJ then pay the debt off. That way the CCJ is removed from your credit record.
if you just pay, it stays on there for the next 6 years. If you've have not made a mistake, you've made nothing0 -
Hi
REAd this http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=12_how_to_set_aside_a_judgment_in_the_county_court . You need to prove that you did not get the letter from the court to over-turn the CCJ. The postal collection details should do this.
Probably explain to the creditor in writing what you are doing and explain that you will pay once the CCJ is removed.
Then challenge the defaults with the credit reference agencies (you may or may not be lucky with this, but try talking to HSBC directly). If you've have not made a mistake, you've made nothing0 -
You need to go over to the CSA Support section here and ask for help re maintenance; the reason being that if you pay privately and then she goes to the CSA, she can claim you have not paid and you have to pay a second time for the period between her raising the claim and the CSA contacting you which can be months, unless you make arrangments that the CSA will recognise.
Will post a cifas link.
Again thanks, i have always paid through bank transfer so have a log of money paid to her every month for that reason.0 -

UNless you have the payment specifically logged as child support she can claim it was a gift to her not Child Support. Please go to the CSA Support forum section on here for advice on the wording. If you've have not made a mistake, you've made nothing0 -
I'd make sure I got copies of all my credit files - all 3 to see the possible extent of the damage. You might also want to do a registry trust search which will flag up all CCJ's - I'm not sure if this is what the mortgage broker has done for you? I just didn't want you to find out about 1 debt to find out there's loads of others.
What a horrid mess she's landed you in - hope you get it sorted.

HI, leftinamess, a very similiar thing happened to me, and i was left with a load of debt and a house which was worth less than the mortgage, as even the central heating boiler had been ripped out and sold. Im doing the house up now, and we are going to have to move back there, but still there are debt collectors calling for him, but at least these arent JOINT debts!! One thing I would say to you, is keep a file. Keep all your correspondance in it, and records and outcomes of phone calls. Ask for things in writing too, because if you do need to get a solicitor later in the day you might need some kind of paper trail.
See what else you can recoup, you may be able to claim back PPI on the loans and cards and bring the money owed down a bit. Give youself some manageable goals to keep your motivation. Also once you have the CCJ overturned, see if you can get a settlement figure, it could be a bit less than the original 1400? Good luck :-)Trying to shift that debt!0 -
It is a nasty feeling just cant see the end of it! thanks for your advice, Finding time is my biggest problem as i work long hours and even doing simple things like ringing the bank to find out about the ccj is the hardest thing as i can not pass security as i know nothing about the accounts! call centres abroad are also a big obsticle.0
