  • Thank you for the templates.
Would anyone know if Link would be able to obtain a CCJ before September? And how likely are they to go down this route?

    In theory they could.

Whether they would really try is another matter?

SLC certainly will do on the accounts that weren't sold off to Thesis/Link.

I also have a vague recollection of Link getting a CCJ for a student loan. Not sure if that was on here, or on CAG/legalbeagles etc?

With a company like Link, you always have to suspect that it's unlikely that they would go for a CCJ, but I wouldn't like to bet on it.

  • Arrived today from Link: LETTER BEFORE ACTION. They're now threatening to pass on my account to an external solicitor and enforce a county court judgement against me unless I pay up in full in 14 days, which I can't/won't. I am really becoming worried now, a CCJ would be a disaster for me. Can anyone please give me some advice as to what I can do to get these scum bags off my back? If I make a SAR to the SLC will that put a hold on Link from moving things forward?
    I am seriously worried now.

I don't think a SAR or CCA request would buy you enough time if you were to go down that route.

Just curious, if it is such a problem with your career, is there any reason not to agree a repayment plan with them and pay the student loan off?

  • Basically, I don't have any disposable income - at the moment I am what you would call a 'job seeker', I'm not quite there yet with my desired career, I think I'm about six to nine months away from securing a position so this next few months is crucial. In the meantime I'm desperately trying to up my income without much success.

I always thought you don't have to pay back a student loan until you earn 'x' amount pa? If you are on job seeker allowance, then you wouldn't have to pay back at the moment anyway? Or is this incorrect?

  • It is correct, you do need to defer payment though, which is something that I stupidly didn't do for a number of years. During this period of time I was unfortunately dealing with the effects of a serious mental illness, I was basically incapable of functioning in any meaningful sense, and my memories of that part of my life are hazy to say the least. So I think that things have gone far beyond being able to simply defer payment, according to Link its pay up in full or else and I don't think that the SLC have any dealings with me now.
