Help with Robinson Way Limited

Hello,
I recently obtained my credit file and was shocked to see that there was an entry for a capital one credit card that i never had in a name spelt very similar to me but not the same. I have since been chased by Robinson way for the outstanding balance of £582. After reading through posts i've sent off a proove it letter and CCA request, all of which have not been responded to within the time set out. I did get a letter to say that they were contacting the original creditor to get this info - but nothing else....UNTIL
I received a letter yesterday saying thankyou for your offer to make £5 payments each month you have now accepted liability for this debt!!!!! I have absolutely NOT sent them any such offer. I have refused to talk to them by phone and have copies of all the correspondance i have sent to them. Can they do this!??? What do i do now!!??
Also this debt is so old it will be statute barred on 20th June this year - i just do not want it on my credit file.

How do you know it would be SB on the 20th of June? Have they supplied info as to when it was last paid?
No of course the *lying scoundrels* cannot get away with such a letter. Write back to them with a prove it letter stating that it is not your debt, it is not in your name and you have never offered to pay anything towards this debt because it isn't yours and that you have never accepted liability for this debt because it is not yours. Tell them you want written confirmation that all traces of this debt will be removed from your credit file within 28days. You might want to end by pointing out again that its not your debt!
And you need to report them to the OFT and enclose a copy of the letter from RW and all the relevant info.
PS best not to request a CCA as because its not your debt you wouldn't technically have a right to see that info - so stick with versions of the prove it letter now.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks so much for your reply. I get confused with all of the options so i may have gone a bit overkill with the requests i sent them.
I only know the date it defaulted from my credit report - they have sent me absolutely nothing to prove tha this is mine and i don't think they have the original documentation as they have said that they have had to send off for it (from where i have no idea!)
Is there a template letter i should send, or should I just write my own and give them 28 days. Should i even bother aknowledging the fact they said i've made this offer which i haven't and ask for proof - or ignore it?
I'm just worried as they are now saying i have accepted liability. I really can not see how they are alllowed to just make things up and ruins peoples credit histories with no actual proof!!!0 -
hi, i will be watching this thread with interest because RW are trying to pursue my husband for a debt he has no knowledge of. It seems to me they are a right shady bunch of characters. If i were you i would ask them to send you a copy of "your letter offering payment of £5 a month". Dont give in to them, thats how they manage to keep going.

That should surely be "a copy of the letter in which payment was purportedly offered" - and wouldn't a Subject Access Request, under section 7 of the Data Protection Act 1998, be rather safer?hi, i will be watching this thread with interest because RW are trying to pursue my husband for a debt he has no knowledge of.
