Letter from Power2Contact

Hi all,

I am in the process of getting an IVA, but have received a letter from "Power2Contact" The gist is, if I don't get in touch with LTSB, someone will come a knocking.

Does anyone have any experience of these? Are they likely to back up this threat?

People seem to like me because I am polite and I am rarely late. I like to eat ice cream and I really enjoy a nice pair of slacks. Years later, a doctor will tell me that I have an I.Q. of 48 and am what some people call mentally !!!!!!.

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date.

    Furthermore, should it be your intention to arrange a “doorstep visit”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yes I've had these. Send the letter Chippy has advised and emphasise that you will only discuss financial matters in writing.

    They will no doubt send you a stock response that the Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R case is irrelevant as only a court can grant refusal of access.

    If so, respond back emphasising that you will only deal with financial matters in writing, and that a doorstep visit will be construed as harrassment and you will call the police.

    Don't worry, its a scare tactic designed to get you to telephone them...... don't fall for it.

  • Just today actually. I received a letter from Power to Contact a couple of weeks ago. And then low and behold had an agent knocked on my door today asking me to contact the company. Thankfully it was an elderly gent who was very friendly and not at all threatening. He just said that I should call them as soon as I can but as a lone female I have to say I would have been a bit scared if it had been a young heavily built male. I'd never heard of them before I got the letter either...

    If they have your work address can they visit you there too? I'm a bit concerned about that now...:(

    In my experience, threats of couurt action are just that - threats.

    They're a second-rate debt collection agency (credit solutions) and just pass the debt back to the creditor once they've exhausted their routine harassment.

    If you do get a visit, they have no legal rights. They can ask if you can make a payment, to which the answer is no. You do not have to answer any questions, and if they do not leave immediately, call the police.

    I live in a remote area and so home visits are rare (not cost-effective to have someone travelling for hours only to be told to F*** Off) but I understand that their agents are more active in built-up areas.

    Any reply? I've been getting phone calls lately regarding my outstanding bill which I haven't paid on an apartment I was living in last year. What's there process? seeing as i dont live there no more, or even in that town for that matter. worried! sleepless nights!

    homershairdo got an IVA which dealt with the whole situation.

    If you're not going down that route, I suggest you start a new thread in the debt-free wannabee forum, where we can explore things a bit more.

    You have nothing to fear from a doorstep visit anyway, but it sounds like they don't have your address.
