Hello to you all and i hope someone can advise me,
I defaulted on a Bank loan in 2000 as i fell on hard times, but the Bank was not very helpfull, they just demanded full payment within 7 days, totaly imposible, so a few months later i got a letter from a DCA stating they had brought the debt, and they harrased me at work for a long time, they never phoned me at home, they just left messages with ref numbers with work mates, and they werent fools so i became the most talked about individual in the canteen this put a question mark over my head by management, and made me very depreseed, so i did no more than bury my head in the sand as they say, i have have never contacted the DCA, and some years later the debt was sold on again to Active Kaptial who keep sending me all sorts of offers to pay this off, so now we are in 2011 and i still receive these offers, and i have read all the forums relating to the limitations act, but as i dont have any credit or debit cards is there any way that i can find out if this debt is statute bared and was does my credit report say.

    If you haven't acknowledged the debt in writing or made a payment for a period of 6 years then the debt will be statute barred.

    If you defaulted the loan in 2000, then there shouldn't be any default/information left about it on your credit report now, as those are removed 6 years after the default.

    As Fermi says, the statute barred letter is the best one to send, but do NOT sign it (print name only), and send that letter recorded delivery.

    It's up to AK to prove it isn't statute barred (which they won't) - not for you to prove that it is.
  • Hello again it has been over a year now and AK have have now employed the services of yet another Debt collector who go by the name CCSCOLLECT.co.uk and they actualy phoned me at my place of work today and caught me by suprise the caller said he wanted to discus this debt, i replied with i believe this to be harrasment, he said that he wasnt harressment that he just wanted to discuss this debt, i replied with that you do know that this debt is statue barred, he replied with so you are not willing to discuss this, i said no and he slammed the phone down on me, so my question is i really dont know where i stand in all this any more, will the phone calls continue and messages with fellow work mates as it was in past years.

    Send the SB letter to this lot also and report to OFT?
