Unofrtunately in this case, no comntract was made as no payment was accepted and Amazon rely on the email confirmation as part of this contract:

I wonder if the article in the Register is totally correct, it states "In short, you don't become an Amazon customer until the company ships your order. At that point it bills your credit card, and the exchange aspect of the transaction is deemed to have taken place and a contract between buyer and seller put in place." It suggests the shipping occurs concurrently with the billing process, in reality the billing will take place first to ensure the payment is successfully made. If payment has been taken itself sufficient to form a contract or is Amazon able to say a contract is not formed until a shipping email has been sent? Some people on HOTUKD claim to have been charged on their CC and then recredited but Amazon has denied taking payment.0 -
very odd, on checking my amazon account this afternoon, it is empty... no record of this order, or an order I had previously made (albeit 12 months ago)
I have emailed them, noticed its now gone up in price, will be gutted.... as christmas present for my dad :-(2007 £1749
