Can someone please confirm once and for all a couple of points?
I have posted in a few threads and got great advice but patchy. I had a letter from HFO about an old Barclays account they said I owed on 13/4/11. Checked my credit file was on there for half the amount HFO are claiming for. Now had a 2nd letter saying 72hrs before litigation! Also saying I must contact them but strangley no telephone numbers on the letter
I have sent the prove it letter on the 13/4/11 but only contact from that was the 72hr letter.
It was defaulted on 27/4/05 so now dropped off my credit file. Def not acknowledged debt or made a payment since 04 atleast.
Am I statute barred and can they still take me to court?
I have heard that if they do pursue through court that the papers dont arrive in time to defend so a judgement is made in my absence is that true?

On that info it sounds as if it is statute barred.
Have you written to them telling them this?
HFO do have a habit of ignoring letters you write to them at first.
They could go to court, but as the debt is statute barred then you would have a complete defence to such an action.
Papers should arrive in time as they are sent by the court, not the creditor. If by some error you don't get them, then it can still be sorted.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Not sent a SB letter as always read on here that best not to acknowledge the debt if in dispute or close to SB and the DCA haven't given proof its your debt. Is it best to send the letter and if so from here via email or recorded delivery?0 -

Once the debt is definitely statute barred then it doesn't matter what you do.
NOTHING you do can 'unbar' it.
However, the letter in this link does not not acknowledge the debt anyway.

I would always send by post by recorded delivery. Just so you have physical proof of receipt.

Or if you are still uncertain that this was your debt in the first place, then this one might be even better.

YES THEY CAN, what good it would do if it is SB then its up to them to decide. But if it is SB and they do, you can turn up to court and make fools of them

Could well be true, but should a default be issued there are plently of forms to fill out that can get it reversed.

HFO are well known for buying SB debts and hoping you do not know your rights.I all have learnt is from others on many sites.
Seek legal help if unsure.

Can somebody help me?
I have recently obtained a credit report from creditexpert and have found that a default listing dated June 07 ,has appeared at my mothers address. I have not lived at this address for over 10 years. The listing also states that the debt of £600 'started' in 2003.
I have never been in correspondence with HFO services and am unsure what the apparent debt is connected to.
Should I contact HFO services by phone or letter. Please note that I am unsure what account if any this default is in connection with. I am assuming that they have bought an 'old' debt and lodged this at a 'last known' address. How do i resolve this? Please help??0
