Enduring power of attorney - NI populace

This is a peculiarity to NI. Having done wills, was trying to get affairs in order, so applied to OPG for LASTING POWER OF ATTORNEY FORMS [1 for financial and 1 for health], DIY cost £120. per form.

Completion guides [very clear] came with forms. However on reading small print, these forms "may not" be accepted as legal in NI. Rang for assistance [not helpful] only to be told to go to a solicitor - yikes! kinda defeats the object of diy for an MSE'r.

Also have to complete epa for NI, not lpas. Not sure what to do now. Life's never easy.

Happy to be told if I am wrong, and any idea how much a solicitor would charge?

Any of the 50+ age group have experience of this?

This is dealt with by the Office for Care and Protection in NI. http://www.courtsni.gov.uk/NR/rdonlyres/4A4E2DD6-C052-482B-832F-B7D93B08EE20/0/p_ul_EnduringPowerofAttorney.pdf

The Office for Care and Protection are very helpful however I strongly recommend you have this drawn up by a solicitor, contact different ones for quotes for the cost.

Red Bertie. I commend you for getting your affairs in order while you are able. Wills and Powers of Attorney are things you should seea solicitor about. I am not one to direct business to them at the earliest opportunity. The sad fact is that too many people do not make a will or provisions for Power of Attorney. In such cases solicitors will make much more money sorting out the mess they leave behind. better to spend a few pounds now and getting things correct the way YOU want them. There is nothing like a death and a will to sort out in a family to she the problems and enmity it creates in many instances!

My Dad recently made a new Will (a very simple one) and an Enduring P.O.A. through a solicitor. The TOTAL bill for both was £265. Hope that helps.

    BigAl is right!!

The master of the court is fantastic!! The staff are amazing, and may recommend a solicitor.

This isnt just for OVER 50's tho, our will stated that if either of us died, everything would go to the remaining person.....

It didnt however say about Enduring power of attorney, if either of us had become incapable of making an informed decision, which DID happen through a car accident, this resulted in a lengthy court case and moi having to provide marriage certs, birth certs, ID, bank account details, the whole heap

So EVERYONE young and old, look at your wills, make sure its not just in Death everything goes to your other half. Please PLEASE PLEASE make sure there is something in there that says enduring power of attorney!!

I cant remember how much it cost, but i know in total my legal bills were almost 5 grand. That was everything tho....house sale, house purchase, barrasters for opposing a decision by the then Down Lisburn Trust to take £10,000.00 out of the sale of the house to pay nursing home fees......(even tho there was still a suitable house to buy AND 4 children)
