Urgent Advice needed re HMRC and bankruptcy please

    Spoken to Tax Aid and HMRC again. Tax aid have advise me to put in an official complaint. HMRC refused to put me through to complaints, but eventually did give me an address to write to so I have written a letter. Tax Aid also advised me to pass on to the adjudicator if I did not receive a satisfactory response in 13 days and tax aid said they will help. Just a little update.

    basically if you were due a refund for any tax that was deducted during the bankruptcy then the OR could claim it, The reason being if you had not had too much deducted then you would have been able to pay that into the bankruptcy at the time

    Thanks debt info-the OR never claimed anything though-he didnt even have a nil tax code. I have told the OR today.

    The OR does not claim the NT like you think, it is the HMRC who put it into place not the OR, The OR simply asks you to pay it in IF it is set up by HMRC, so in your case there was nothing to claim. The OR can and very often does go to HMRC later and ask them to handover the tax if the NT is not applied. In this case it is a totaly different situation because this has nothing to do with a NT code but a different set of events in which he has overpaid tax
