This isn't a complaint, what you can do depends upon the date of the agreement. This is between you and the council so get an application in PDQ.

I am trying to point out that this person is following the wrong path.
It is patently obvious that my attempts at demonstrating my knowledge of this particular area are futile on forums where people are apparently happy to continue as they are..

Thanks all for your interest in this matter. Yes I did know about the terms on the Lease when I purchased the property BUT I was never informed that this will have an effect on getting a mortgage. I had no idea that High Street Lenders were not willing to offer mortgages on such schemes. The only thing I was told by my solicitor (who were recommended by George Wimpey) was 'these are unusual terms' and that was it. end of.
Let's not forget that the target market for these properties is First Time Buyers, who like, me have never come across anything like this before.
but your main problem is going to be that lenders criteria change regarding houses so what they would lend on 5 years ago will have changed by today, in your case this may be unforseen - its the same with non standard construction houses, a lender may have seen it as acceptable 10 years ago but not now0 -
Indeed Poppy, times do change, so therefore the terms in the Lease should at least be negotiable to cater for such an uncertain market. I have had a document based on Best Practice when setting up Affordable Housing. This document was made by Chartered Institute of Housing and the Homes and Communities Agency. My s106 Clauses go against everything in the document.0

Please complete an application to vary or discharge the S106, your council should have all the required forms, there is no fee to pay.0
