Council tax & Bankruptcy

Hi Guys..

Hope someone can help me with this. As ypu know we have had out big bankruptcy day and its all gone very smoothly.

Saturday we recd a letter from a bailiff for a council tax that was included in the bankruptcy. They state that this week they are coming to collect goods to sell at auction, they can do this with or without my attendance and will bring the police if they so request.

HELP !! I have tried calling them all weekend and the numbers are all vouicemails, they know ive one bankrupt.. This is a bit worrying...

Any advice or sugestions would be great !

    Hi Mike ,sorry don't know anything re the legalities of bankruptcy / council tax, but I do know that you have no legal obligation to let the bailliff into your home,they can only enter via an open door or window. I do very much doubt that the police would arrive unless its to prevent a "breech of the peace" and in anycase you still DO NOT HAVE TO LET THEM IN. my advice is if they turn up on your door step ignore the door, do not open it,or they will try various tactics to get a foot in the door ,ie by saying "just sign this "etc
    They will go away eventually, as they can only claim payment for two visits in respect of council tax.

  • Hi Mike. No positive advice to give you except to ring the O.R. as previously suggested. Just when you think you can move forward with your life , you get dragged back down. 2 steps forward 1 step back

    really sorry to hear about this.

    bailiffs: lock all your doors and windows and when you are in the house keep the doors locked. an unlocked door can be taken as an open door if the bailiff tries the handle. i.e. a double glazed door. and they will try to get through the smallest cracks in the windows if they manage to get even one finger through it they have then gained entry and there's nothing you can do about it. as before the police are only there to make sure no breach of the peace occurs.be careful about letting the police in because quite often while you are letting them in the bailiff will put his/her foot in the door and has then gained entry. they are nasty serious little !!!!!!s and will try anyway to get into your house, even as much as going into your back garden to see if there is a way in there.

    get in touch with your OR about council tax being included in the bankruptcy.

    have you had your appointment with the OR yet?

    Just spoke with the OR. It is included... They said do not let them in and simply call them and tell them to call us if they have a problem with it !!

    I still think ill lock the doors and windows !

    He just called and said that the council tax doesnt go with the bankruptcy !!

    I put him right I did........

    If he calls now that you have informed him of the situation he WILL be acting illegally.

    I know.. I told him that also.. To be honest he wasnt that bad, just didnt jknow his stuff. Still there are plenty people out there that would believe him and pay up !

    Thanks guys.. Can get back on with my euphoria again of being debt free !!

    Time to pain to the kicthen today.. Last job then its all done !
