Data protection act/ Freedom of information Charge

Hi

I need to see what the council have about me so i requested the information under the data protection act and freedom of infomation act. They informed me that i would have to pay them £10 + Vat. The funny thing is they could not work out what £10 + 17.5% was.

Is it right that they can charge vat on top of the £10 charge.

    No, they can't.
They may also ask you to pay a small fee of up to £10 (including VAT).

Tell them that if they insist on this amount (they are not allowed to), you will report them to the Information Commissioner.

Remember that VAT is not a flat rate of 17.5% and depends on both what the item is and what the VAT status of the "company" is.

That said and done others seem to have found that the answer is that they cant add VAT on top of the £10
