CCJ Removal advice.

I have just checked my credit report and noticed a CCJ that was granted in June 2006. There is also a default for the same debt which was granted a few months earlier.

I did not recieve the summons or the default as i left the country in 2005 and come back in 2009.

Is this a good reason to have the CCK set aside? If so how do i go about doing this?

    Not normally a good enough reason just on it's own.

    The address that they had on record was still my uk address. My parents would always inform me of any letters of importance. They do not remember recieving any summons as if they did they would have told me.

    Who obtained the CCJ against you? if it was any of the major banks I would think the chances of them not having sent the court paperwork would be exceptionally slim.

    Were your parents actually opening all your post then? this paperwork would only have been sent normal post, not registered or anything. I guess its possible they missed it?

    I suppose you could possibly issue a subject access request to see all the papers held on your creditors file to see if you can see a record of it, but my guess would be they'll be able to demonstrate that they sent it.

    howard and cohen solicitors issued the judgment against me.

    My parents always opened all my post and informd me of any important letters. They may have missed it, i cant say for sure but they dont remember recieving any summons.

    How do i get a subject access request, what is it and who do i ask for it?
