threat of Bankruptcy from CrapQuest

Hi there,
I had a letter today from CapQuest saying they are preparing a STATUTORY DEMAND which wil be served against me for £1320.

The thing is I have no assets, I rent my home, I have no Car or bank account or even a TV. and I'm a full time carer for my disabled wife.

I have several small ish debts (all in the lower to mid hundreds) and TBH I would welcome a bankruptcy to be able to start again.

Should I apply to set it aside or should I let it go through - what are the consequences of letting this go through.

Oh BTW - CapQuest have done all this without even producing a SOA or WCA for the alleged debt. I claim its statued barred but they wont prove it.

    The chances of CrapQuest making you bankrupt for that amount are absolutely minuscule.

    You say it's statute barred? Have you send CrapQuest a letter telling them this by recorded delivery? If so, what have they said in response?

    Letting any statutory demand go through doesn't have any negative consequences for you if you're not bothered by bankruptcy. Although, with a statute barred unproven debt I would be tempted to set it aside anyway, just to annoy CrapQuest. You may be able to even claim costs against them when doing so. ;)

    Dear DCA,

    Thank you ever so much for your recent letter with a view to you petitioning for my bankruptcy.

    You have no I idea what a relief that is, as my finances have taken such a turn for the worse.

    I have been struggling to find the £625 fees required to file for my own bankruptcy. So much so I have not been able to sleep at night worrying how I would achieve it.

    I realise it will cost you £820 plus significant legal costs to do this.

    Considering I have no assets nor enough income to contribute anything to my bankruptcy estate in the form of an Income Payment Agreement, which means you will not recover any money for doing this, your act of generosity has left me lost for words.

    But thank you for relieving me of the pressure I have been under, and allowing me to sleep soundly at night knowing I no longer have to worry about finding the fee for myself.
