Urgent Advice Needed

This is my first post under my new registration, was previously registered but not sure what happened to my account. But i had to re-register to get you urgent help.

Ok, the situation: I split with my ex partner about 2 years ago and at the time we had alot of joint debt. We evenly split this and each agreed to pay our share until paid off, my half was pd off by a family member and her half was left on the joint loans as at the time the bank wouldnt take my name of them due to affordabillity for her.

We also had a mortgage on a house which she agreed to keep and again it was something the bank wouldnt let her take on her own so i she agreed to take on ownership of this and rent it out, She ws making good profits on this per month of about £300 per month which we agreed would go towards paying off a £1000 overdraft we had then afterwards she would just keep as i didnt want anything to do with the house. I also filled out a form to have my name removed from the joint account and sent this to her to sign and hand into bank.

Problem: About 6 months ago i recieve a call from the bank out of the blue asking me to pay money back to a bank account that is overdrawn. correct, the account that was meant to be paid off was now £100 over its overdraft limit. I went crazy at the time and couldnt believe it was happening, She did nothing about this account and it accumulated charge now at £1500 before she eventually went to CAB and agreed a payment of a massive £1 a month repayment to the bank for this. I contacted a lawyer who wrote to her re this debt and the other debts to which there was no reply.

Next thing i know more recently the bank have not been recieving the repayment of this £1 a month and the account has been passed to a debt recovery agency. Im fuming, theres surely something i can do as its just not fair that im left with all this debt let alone half of it. Now to make things worse she contacted my lawyer and said she is considering bankrupcy, i have then been told if this happens i will be liable for all the joint debt, all loans, overdraft, mortgage etc. How can this possibly be fair????

The bank originally wont let her take on the full debt because of affordabillity but as soon as one person cant pay there happy persuing one person regardless of affordabillity anymore.

    Hi, sorry to hear of the issues you are having, however as far as I am aware you are joint and severally liable for debt in joint names. Therefore if she does go bankrupt, and your name is still on the accounts, they can come after you for the full amount.

    Hope you manage to get things sorted out.
