Hi
I apologise if I have duplicated anything already stated on a previous thread - I couldnt find anything similar.
Please HELP!!!
After, very stupidly, running up a lot of credit debt and being on the payday loan merry-go-round for a year or so I have decided to stop digging my head in the sand and sort my mess out.
I emailed all my creditors including Wageday Advance and PTP on the 19th April 2011 advising I would be unable to pay the loans I have on the due dates, and humbly asking if they would accept a payment plan. I've spent so much money in fees and interest with these people, and at the moment barely have the wages to make the repayments so it was worth a shot.
PTP havent replied but I received a reply from Wageday Advance agreeing (after adding a small fee to the balance) to accept three monthly payments of £135 followed by a review of the remaining balance which would be £256.
I emailed back the same day thanking them and asking for the bank details to make the repayments. I didnt receive a reply so sent a reminder on the 22nd April chasing payment details.
On the 26th I received a reply apologising (the lady had been off sick) giving bank details. However also on the 26th £137 was taken from my bank via my debit card (I cancelled the DD instruction)
I replied saying as they had taken £137 (miscalculation?) I assumed that was my first installment?
I received the following reponse -
"In the last email I sent I asked when the first payment would be made, as there was no reply the direct debits were sent for the deferral payment. Unfortunately this has not come off the balance of the loan.
I can start the payment plan from the end of May, but the balance is still as it stands at £661 including the set up fee. Please advise if you wish for the payment plan to be set up now."
I disputed this saying I had agreed the repayment plan (and was waiting for bank details to pay) and have now received the following reponse -
"Once the direct debits have been sent, we cannot recall them back from your bank. The funds that were taken, was the deferral payment that you put in place and also a £12 default charge for the direct debit being returned. That is why it does not come off the balance of the loan. Deferrals just hold the account a month until your next pay date. We also do not have to set up payment plans, and they are just a gesture of good will. The payment plan had not been finalised between us that is why the direct debits had been sent"
Can someone offer some advice? I know they dont have to offer me the repayment plan, and am very grateful they have. But can they take £137 from my bank without my say so 7 days after agreeing a repayment plan and NOT use it to reduce the balance :-(
Thank you

Ps Sorry, I know it's a long one!
