Hi All,
Im new to the forum, great reading.
Im in the process of sorting out all my debts, and am now nearly debt free from 50k (15k to go!!)
One of the debts, 10k is with wescot (reasonable to deal with) the other 4k is with Connaught (b**tards)
I have offered Connaught a F&F of £1300, they want £3200, fair enough, but I cant afford that. They want £150 per month, I can only do £25... they have hit me with a statutory demand and now want to make me bankrupt. I have no assets, bank account or anything. I told em I would send the £25 anyway, they told me not to bother, and wait to hear from the receiver.
Has anyone else had problems with these guys?

Send them a copy of your SOA showing why you can only afford the £25. Have you got everything in writing? Including your offer? Even if they do take you to court you can show to the judge that you have made an effort to repay but they have been unreasonable and most likely he will throw the case out on the basis that you pay the original offered amount.Total 'Failed Business' Debt £29,043

You can not pay more than you can afford - whatever they say. The worst thing they can do is to take you to court and then you would have the chance to explain that you have offered these 'vultures' £25.00 which is ALL you can afford, and you can explain how they have responded. The judge would take that into account and would not order you to pay any more than you can afford. Then Connaught would have to leave you alone.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I hope you don't mind me posting, I've been a lurker on MSE for ages but have only registered today.
Do you really not have anything you could sell to raise the funds in the short-term? Do you have a car that you might be able to down-grade?

I agree with Rog2 and ImmoralAngel - you can only afford to pay £25 per month. Show them your SOA to prove that this is all that you can pay and continue to pay them that every month no matter what they say. They may just be threatening to make you bankrupt in the hope that you suddenly find the stash of money that they think you are hiding under the bed (lol) - that will be the same stash of money that Northern Rock think that I have!!! If you find it give me a shout and I'll have another look for mine!
Even if they do take you to court, it will stand in your favour that you've made a reasonable offer and made regular payments. I wonder if the reason that they have said to you not to bother paying the £25 is because they want to make you seem bad in court? I bet they only said that to you verbally and wouldn't have put it in writing? I'm getting really cynical now - must have been dealing with these type of pirates for too long!!!0 -
What gets me with these guys is,
I have succesfully offered and paid 23% F&F on an old lloyds debt, 40% F&F with an old barclaycard debt. I told connaught this, and they said "we arent mugs like the rest of them, pay the debt or we will file you for bankruptcy" and they HAVE to have a repayment plan that takes 23 months to clear the debt.

I doubt very much that they would file for your bankruptcy, homer. Legally they COULD, but in practice it is very unlikely because they would have to pay up front fees, with no guarantee of getting them back, and even if they were successful in petitioning for your bankruptcy, this would not give them priority over any of your other creditors. You, on the other hand, could defend your position in front of the judge and tell him of your efforts to reach an agreement with these thugs. The judge is more likely to rule in your favour than in theirs.I am NOT, nor do I profess to be, a Qualified Debt Adviser. i woud just pay what you can afford and dont enter in to phone chitt chatt no court will make you bankrupt if there is a chance you can make regular payments no matter how small the dca are just full of hot hair ignore is the best solution they are trying to panic you with everything they cant do0
