Just don't know what to do - DRO or BR?

I'm hoping someone could please advise on my best course of action.

I'm aware of the £15K threshold for the DRO, and it's cutting it fine already.

The Santander debt is due to increase by £150 on 13th May (when they add charges). Santander are still yet to close the account.

That then makes my debt £14,994 on 13th May, after they've added those charges.

I've got all of my statements together, ready to send to CCCS for the DRO, but am just worried that by the time they put it through / I've got £90 to pay the DRO fee, I'll be over the £15K threshold :o

Am still waiting for some statements, to show debts for -

Rent;
Council Tax;
Housing Benefit Overpayment;
Santander;

I feel stuck, as I can't even afford the £90 fee, and within weeks I'll be going over the £15K limit.

Then if I have to go bankrupt, there's no way I can afford the £500 - 600 fees.

Embarrassingly, I went BR back in 2003; Discharged 2005.

Am worried I'm going to be in serious trouble for having to go BR a second time.

    Forgot to say, by next week I should be bringing in an extra £25 per week from 'Permitted Work', while on ESA.

    That then should balance the figures, giving me a surplus of £35 per month left over.

    Would your ex partner be willing to suspend payments for a year? That would put you under the £15k threshold if you didn't declare what you owe to the ex. Don't know if that's allowable, but as it's not a traceable debt...

    It is tempting. I don't want to break any laws though :o

    Don't think my ex would be reasonable about this anyway.

    Also, I declared it to the CCCS guy over the phone last month, and it's showing on my budget under 'Misc' as 'Loan from family / friends'.

    I feel completely stuck :cool:

    In relation to your debts, can your ex partner prove that she lent you the money?

    Only provable debts go into the DRO and for most people loans from family/friends are so difficult to prove as very few draw up agreements to sign.

    You said you are sending in the statements to CCCS, would it be a good idea to ring them and check whether this has to be included?

    Hi mazzatee,

    Good point.

    She can't actually prove the loan as such. I mean, she can probably show debit card payments from her account, but the actual existence of a 'loan' can't really be proved, no.

    The irony, is that I asked her last week to send me something in writing so I have something in writing for the debt, to show CCCS.

    But now, I'm over the DRO £15K limit.

    I will indeed call CCCS in a min.
