reclaiming PPI on old SPML SPPL accounts

Hi all,

in April 2004 we sold our house and paid off loans with Southern Pacific Mortgages Limited and Southern Pacific Personal Loans. We emigrated later that year and in that process lost all paperwork relating to these accounts.

I would like to know if it is possible to pursue PPI claims against SPML and SPPL even though it was quite a while ago and I have no paperwork/account numbers at all?

There is a possibility of obtaining account numbers from the solicitor who handled the sale of our property but not a lot else.

I have read on other threads that spml and sppl have changed names and may be even more difficult to reclaim from.

My now ex-husband wants to reclaim through a ppi reclaiming company, I'd rather try to do it for free via MSE help, but wonder if as this one is soo tricky it might be best left to that company? (i am very bad at paperwork etc)

any advice greatly appreciated!

    Did you buy the mortgage direct with them or through a broker?
    Was it single premium MPPI or monthly payment?

    im pretty sure all SPML and SPPL sales were through brokers.

    Thanks for looking at this for me.

    I seem to remember someone coming around to our house to do the remortgage - so I guess that would be a broker.

    I can't remember if we had PPI or not - but if we did it wouldn't have been through choice as being SPPL/SPML clients we were in a mess with our finances and wouldn't have chosen to pay out anything extra that we didn't have to. hence the mis-selling would have been by being made to have it.

    So, any complaint you make has to be to the broker. You have no complaint against the lender.

    Having PPI is not a mis-sale. Just as not having it is not a mis-sale either. It was how it was sold to you that matters and in some cases how it was set up. If you don't even know if you were paying it then how can you complain about it being sold to you incorrectly?

    I am trying to reclaim my PPI from these people at the moment they are now Acenden Ltd
    PO Box 1075 High Wycombe HP11 2WX
    I would start by sending a subject access request to them (this will cost £10) then you will be able to ascertain whether or not you had PPI on the loan.
    As you have been advised it is the broker you go after who sold you the insurance. Acenden will tell you who this is.
    You will probably get nowhere with the broker because back in 2004 they were not regulated but you have to exhaust all avenues before the Ombudsman will take on your case.
    It has taken me nearly 4 years to get to this point the ombudsman have taken on my case and are going after the underwriters of the insurance (my loan was taken out in 2003).
    I tried a reclaiming company and they were hopless they got nowhere. It is not tricky you can do this yourself. Shout if you need help!
  • wonder if anybody can help me !!

    i took out a secured loan with SPPL back in march 2007 and it had PPI attached to it. I was sold it by a broker which i have the name and address of and the loan paperwork.

    how do i go about claiming the PPI payments back ? I was self employed at the time so believe would have been wrongly sold.

    Loan was for a 25 year period but paid it off after about 3 years. would it still be worth claiming ?

  • hello, i was looking to see if anyone could help me regaring a claim for ppi on a mortgage with spml.

    i took out a mortgage with spml in 2003, which had £6000 ppi added to it on the original advance, to cut a long story short, we got into difficulties with the loan and our house was repossesed and subsequently sold. the mortgage was reedemed from the sale and the final statement sent to me was dated 7/2/07 stateing the balance was now zero (£0).

    now, my issue here is who to try and go after for the ppi, as the loan was arranged through a broker, who visited us to do all the paperwork etc. after he left, we receieved various updates from him regarding the progress of the application, mostly via telephone. finally he phoned us and said the loan would be approved but 'only if we took the ppi' - obviously to get the mortgage, we agreed. . now normally, i would say it would be the broker who missold me the ppi but i have an original copy of the mortgage offer and it states on the 'special conditions' attached to the mortgage note #144 - payment protection plan - the offer includes the provision for payment protection insurance cover, arranged by the lender. the single premium is quoted in the leter of offer etc etc, at the end of the condition it finishes by saying 'the application form for payment protection must be recieved by the lender prior to completeion of the advance'.

    the broker told me it was the mortgage company requesting that i took the ppi to get the loan or they would not offer, but i do not have this in writing as it was done over the phone.

    im now looking for advice on who i should lodge my complaint with - the broker or spml - if its spml, should i send direct to capstone in high wycombe or have they now moved on to another name/address.

    any help would be worthwhile - thank you
  • Just wondering if you had any success with your Ppi claim against Sommer as I'm about to embark on the same and I don't know if it's worth the effort.
