Help! DCA letter for debt we had no idea about.

Dh recieved a letter today from 'Global debt recovery' sent to his mum's address... this is what it says.

''Client Lloyds Tsb bank PLC
debt due £515.21

we write to inform you that we will now recommend to our client to proceed with litigation.
following any county court judgement recorded against you fixed court fees and solicitors costs will be added, which will significantly increase your debt. Upon judgement being entered, the following choices of action are available to enforce payment.
Bailiffs warrant (It gives explanations of each of these..)
attachment of earnings order
oral examination
bankruptcy proceedings

we are now preparing your case for litigation. However if you telephone us on 02083367106 before 12/12/06 and arrange repayment of the debt we will consider suspending any legal action.''

Dh has a lloyds bank account up until this time last year when we switched banks and he cancelled it without anything owing on it. The only other debt we know about and are waiting for a dca to contact us about is capital one so god knows where this one has come fromand we have had nothing whatsoever about any apparent lloyds debt. 2 of Dh's debts have been paid off recently including 1 to a DCA so could these guys be chancers, especially as it was sent to Dh's old address even though all our creditors know our new address..

Not sure what to do? Can anyone advise? It's just typical when we start sorting ourselves out something comes back and bites us in the bum.

  • Quickie update: DH just text me to say he thinks it could be a mastercard that he had back when he was 18 (he's 28 now..)... so what do we have to do??? I presuming it's probably statute barred but should we get his credit reports first and see what they say.. or should we just send them the usual 'I don't acknowledge the debt' letter....

    Don't panic and do not acknowledge it!

    Also part of me thinks, it was sent to his old address, would he have received it .....:confused:

    Well no, his mum brought it round. I'm just worried about it wrecking the good work we're doing paying our debts off!
    If we sent the standard do not acknowledge letter, should we put it from his old address? Because surely they think he still lives there.

  • are you sure they are a bonafide company and not one of these dodgy ones trying to scam the money out of you? Id do some checking and adress your letter from the address they sent to rather than divulging any new info.

    Hi Immoral,

    It looks like a standard DCA letter - they use all of these 'threats' to try to scare you into paying, without questioning the debt.
    You need to find out if this 'debt' is yours BEFORE you make any agreements with the DCA.
    Do NOT phone them - write to them and tell them that you do not acknowledge any debt to them, and ask them to furnish you with a true copy of the original credit agreement, then do NOTHING until this has been supplied. They must supply you with this information within 14 days or they can not attempt to collect the 'debt'.
    If the DCA phones you, then tell them that you will ONLY communicate with them by letter.

  • Thanks.. I'm presuming as they've sent it to DH's old address they wouldn't have our phone number anyway.. but do we send the letter as if it's from his old address?

    Is his old address the same as his parents? If so this would be ok.

    Just looking at the letter again, I'd like to reassure you on one thing - they CAN NOT petition for your bankruptcy for an alleged 'debt' of £550.00 - the minimum debt, for the purpose of a creditor petitioning for a debtor's bankruptcy is £750.00.
    This is a 'scare tactic' letter.
    Do NOT give your phone number to any DCA - they will harrass you from dawn till dusk. :mad: :mad:

    Yea it's the only other address he's ever had. I thought that about the bankruptcy thing and they used the word litigation a lot which sounds scary until I found out it just means legal action. I hate DCA letters.
