Joint or individual ?

I have recently been given a Debt Releif Order but hubbys DRO was sadly refused (long story).

Hubby stopped paying his creditors back in November last year when we started talking to the advisor from NDL and putting together the paperwork etc to submit applications for a DRO.

Anyway NDL advisor now recomends we start from the beginning again with hubby and write to all his creditors offering them the £1 token payments and asking for creditors account info so he can set up a monthly Standing Order to make sure it is paid on time each month.

I dont get a 'wage' as such as I dont work (am on Incapacity Benefit) so other than hubbys part time Self Employed earnings the only other income is th Working Tax Credit he is entitled to (which is paid into my account) The income that pay the priority bills and food are the IB and WTC both from my accounts as I manage the household. Hubbys other earnings basicaly go to fund his business overheads, pertrol for the van (our only vehicle) and a few other bits hubby likes (fags and magazine subscription) but they dont add up to much each month, no more than a night out a week which neither of us do regularly.

I am doing hubbys Income and Expenditure sheet and my question is do I supply his creditors with a joint income and expenditure or just his income and expenditure?

    The problem with doing a joint one is then you're offering up your info, which they will then take into account. Is there any way to simply figure out what his "half" of the income and expenses are and go from there?

    We figured ours out that way. I don't work, but I have money that comes in specifically for our children (child benefit, DLA for our 4yo son) and that money is used for their needs, so it does not get figured into the income at all.

    I'd go for single - and if they start to query say that you've got a DRO and that your income and outgoings is monitored by the OR (not strictly true, but may be enough for them to back down if they ask for joint)

    Thanks for replies thats what I was thinking of doing. I dont understand though how I can show half of what his money pays for?

    Does this mean that I just put down for example he pays £250 for rent (when it's £500 a month) etc or do you mean I just show an outgoing of his Tax Credits as a 'lump sum' towards food and the remainder of his wages for fuel and a few other bits leaving just enough for £1 towards each creditor?

    Do I even put hubbys Tax Credits entitlement on his sheet as they are paid to my account? What about the IB as that is my entitlement and in my account again.

    Wont they be wondering either how bills appear so 'cheap' at half the cost or why he spends all his money without paying any bills at all other than to me (as 'other outgoing') or on food ?

    His creditors obviously know he is not single.


    Geesh its so confusing and I dont like to keep pestering NDL advisor as I feel stupid.

    Might help. And maybe with notations of what comes out of his account and what comes out of yours. It can get confusing. LOL

    I already have a DRO solely for myself which obviously means my income isnt enough to cover my creditor debts. So when or if they do take into account my half there simply isnt enough left for me to pay his debts as it is we are struggling still.

    Would make it so much simpler to submit it jointly but theres 2 questions 1 do I tell his creditors I am subject to a DRO and 2 he is self employed (part time income at the moment) so he has to go via Business Deb Line which makes it a bit more confusing than it alrady is as he doesnt have a lot of overheads as he works from home in a mobile sense that he goes to customers.

    :eek: arrrgghh it is so confusing ! Thought having a week off from dealing with it would unscramble my brain but it hasnt. :o
