A few questions re: CCCS

Hi everyone,
We have started the process with the CCCS they are calling next week.
I have cold feet mainly because of the following, if anyone can help i would be muchly greatful
I am worried, because we have a mortgage through Direct Line (RBS) that isn't in arrears and have no problem paying, but we bank with Natwest (also RBS) and have a loan, CC and overdraft that would go the CCCS. I am worried because they are the same group will this cause problems for us? i.e will they get a court order to try and do something with the house?
Also: We are upto date with payements but are really struggling to live on the money we have left every month, if we through with the CCCS and try and sort all this out will the companies involved try and get CCJ's against us or such.
Can any of the companies we owe money to, try and file for bankruptcy I am so worried about loosing the house it's unbelieveable, to the point where I am considering not using a DMP and continuing to struggle every month
Basically I need to know whats the worse they can do to us before we make any decisions.

without knowing anything of your circumstances its difficult to advise.
you really need to look at what is likely to happen rather than the worst possible scenerio.
if you enter a DMP you can expect all your accounts to be defaulted which will trash your credit record but should not affect your mortgage.
it is possible that they might get a CCJ but most people who are addressing their debts through CCCS/Payplan aren't issued with CCJs.
In principle bankruptcy can be applied for with a debt of only 750 but i'm not aware of this actually happening in your sort of circumstances.
why dont you post a SoA here and see whether people can help you
also add details of your family situation (OH, children) and how much the house is worth and how much the mortgage.
but dont worry too much about things that probably wont happen.0 -
Thank you for replying, maybe I have to discuss all this with the CCCS. I have posted a SOA before.. I think I would rather be skint than anyof that happening

Personally, I would be surprised if the mortgage would be affected - the CCCS would be able to help with that.

I am also on a DMP with the CCCS and have a mortgage that is up to date. The CCCS have been so helpful and the mortgage is not included as there are no arrears on it.
It is difficult to say if yours will be the same but it is likely, All my creditors have accepted the reduced payments but Natwest are still applying interest so the balances are increasing. OH HUM
The others are decreasing at last.... To date I have not had any threats of CCJ and only one debt has been passed to a colllection agency and that was the smallest one of less than £100.

i've had a quick look at your previous post with the SoA but it doesn't seem you ever completed it (sorry if i've go it wrong but its quite a long thread), so its not really clear whether you can continue muddling through or not.
in the end its often the lesser of the evils rather that whats best.0 -
Thanks everyone. Maybe I didn't finish my SOA I thought I had maybe I missed what was left to put on it. TBH muddling through is what we do thats it, we really have hardly any budget left for food shopping etc. I really do think we'll end up living on beans on toast.
What scares me with doing the CCCS is that, No one can tell me what the creditors are going to do, we don't know if they are going to agree etc.. and then it's all to late then to do anything about it and we're stuck in the middle with the CCCS and may end up going to court or loosing the house etc..
Maybe I need to do a new SOA, what do i need to put on it?0 -
Sadly the creditors tend to do as they damn well please. If you can't afford to pay them all you can do is offer what you can afford.Barclaycard 3800

We were in the situation where I was food shopipng sometimes with less than £10 in my pocket for a week. That's when I said enough is enough. We both have great jobs which pay quite well, it was ludicrous.
The CCCS will be able to tell you what you should be spending on certain items in order to create a realistic budget. Food shopping budget is actually quite high. If you are to go onto a DMP, the food is a priority so it's counted into your budget. Therfore on a DMP you don't have to struggle to do basic shopping.
It is a Godsend to us.
Our mortgage was one month in arrears when we initially spoke to the CCCS, they didn't mention that it would be effected - the arrears was added to the budget (as adding £100 per month to the payment to clear the arrears) and therefore wasn't put through the CCCS at all.
All the money on your budget with the CCCS is yours....the money at the end of that will be allocated to the CCCS for the DMP. In theory, with a DMP you shouldn't find yourself short, as long as you're responsible and don't overspend.
I urge you to speak to them, you could run through the process with them and even get all the paperwork through - a DMP cannot begin until you have returned your details and your signature/s.0 -
Thanks Vicki, for sharing, our debts are around 48,000 I think.. Thats why i'm worrying about the house etc.. I don't want to loose that esp with my two toddlers and the shame of having to tell family etc. I felt better when I initially spoke to the CCCS but these worries are now going round and round and its making me have doubts.0
