Net income - the assessment is based on the relevant income, but they can take 40% of the net income to recover maintenance plus arrears.

    Ouch, that doesn't sound fair,but can't say I'm surprised.

I've found this can vary between teams, and also between different case officers...some treat it as 40% of the actual income used for the assessment purposes, even if they should really be setting arrears payments as 40% of net income.

Pyments can be UP to 40% of net income, so can be absolutely anything up to 40% of net income.

Thanks again everyone....partner is at work today and cant use the phone so i called csa myself to advise but as im not authorised to speak on his behalf blah blah blah! but i have done it and documented that i called!

Get him to tell the CSA that you are authorised to act on his behalf and then you will be able to call them to sort things out yourself.

Finally got it all sorted....ended up taking a loan to pay the arrears to get it out of the way, and of course as soon as they hear they were getting the money they couldnt have been mor helpful!! Calling back when they said they would and going out of their to ensure their questions were answered!
As i said before guys...thanks for all your help and again just let it be a warning to other people out there....dont let arrears get out of control as one thing I have found with CSA is that they can be VERY manipulative, very unhelpful and more or less just bullies when you need help or advice!!
I have and will always maintain that CSA payments are and should be a priority payment, but they really dont give the 'second' child a fair deal when they are 'negotiating' payments.
