Help with CCJ

Today my hubby has received a CCJ.
I will not bore you with the details its a civil matter not a debt.

My query is that it is addressed to MR ***** (our surname) but no christian name.
I always thought that you had to have a persons full name to enforce a ccj.
Does anybody know if that is the case or is it another one of those myths?

  • Have you previously received a claim form and made a response for admission, part admission or dispute, or has the order been issued in default?

    Also is the missing Christian name actually on the order itself ?

    No nothing has been received previous to this . This is the first letter the county court has issued. We now have 14 days to admit or defend.
    Its one of those his word against ours, quite pathetic really but I guess thats his right to try & make my hubby pay.
    I am familiar with ccj's as I issue then at work all the time & I know that in business the name has to be exact.

    There is no christian name anywhere on the paperwork.

    Where do we go from here?

  • Sounds like what you have received is the blue N1 claim form?, and if this is a debt / claim that you are aware of then it would be your duty to compete this accurately and include a Christian name.

    At this stage an order has not been issued, and if the debt was not yours and you had no knowledge of it you would complete the section for “dispute in full”

    If a full order had been issued without a christian name then potentially you could apply for it to be set aside, however the likelihood is that even if the original order was set aside then the court would instantaneously re-issue a second order to include the full name

    N.b all of the above presuming that the application is lawful, and that the court decided to award in favour of the claimant.

    I think that my husband will be legally obliged to put his correct name on the paperwork.

  • Hi, This Will Become A Debt If You Do Not Act Accordingly First Admit Or Dispute The Claim If From What I Read You Are To Dispute Then You Will Need To Go To Court Dont Forget As They Are Taking You To Court You Have The Right To Have It Transfered To Your Local County Court So You Can Attend And Defend Ive Attended ,it Is Very Easy And Straight Forward

    I think hubby is still deciding if he is going to defend. I am aware he only had a few days to return the form.

    It could all boil down to a principle!!
    Do we need the stress I ask myself.
