Recieved paperwork from our local courts for an application against me from Hyundai Finance (was a personal loan to buy a car and not a car loan)
Now, I have asked twice for the signed credit application and the 2nd letter stated that if I had not heard from them in 14 days, I would deem the debt unenforceable. But, silly moo here did not send either recorded........
Anyhow, we have enough money to do the bankruptcy thing now, and I do not really want to waste courts time over this matter, but my choice is this - do I admit liability, fill in the forms and offer £10 a month, or contest the claim stating that they haven't given me a copy of the signed credit agreement after asing twice (at least I kept copies of that!) and that I intend to go BR in the New Year anyway.
What I do not want is for them to "win", then not able to pay what the courts suggest (if my offer is not acceptable) and then they remove the car anyway with a further court order - although I think this process would take longer than a few weeks anyhow. I believe the OR should take the car and split it between all my creditors - not just the one.
So - suggestions! Should I contest it anyway (which I am vying for) or accept and offer something I can afford in the meantime.
I believe that neither will affect the outcome of BR anyhow - any CCJ will be "wiped" when BR takes place and the OR takes over.
