Hi i have been reading various posts on here, i am just starting a DMP with CCCS with unsecured debts of around £32K due to 4 credit cards and a personal loan. I am really worried about being taken to court and debt collecters calling if my creditors don't accept my payment. My creditors are MBNA, barclaycard, Capital one and RBS, a personal loan is with Sainsburys bank. Any advice would be much appreciated i am not looking forward to the phone calls and letters the worse thing is the four cards are in my husbands name and it's me that has got us in this mess buy borrowing from peter to pay paul. Thanks again for any help.

Hi
On a DMP as you know its always possible you might be taken to court and there is little you can do about it if a creditor decides to be difficult and take this action. But despite the impression you might get from here CCJs are not that common whilst on a DMP. Unfortunately people tend to post more if they are having problems with their DMP than if it is going well so I think it can appear that CCJs happen more often than they really do. But of course nobody could say it won't happen to you.
Regarding debt collectors calling - I'm not sure if you mean phone calls or calling at your property but both can be stopped with a couple of template letters we can provide.
Good luck with your DMP, I hope it works out well for you.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

Hello :j Try not to worry too much. I started a DMP on my own for more debts with CapitalOne, BarclayCard, BarclayCardLoan and MBNA and I was not taken to court.
MBNA straight away stopped interest and charges and never even defaulted me, my account was not even listed as Late Payments with the CRA however had a marker saying arrangement to pay. After 15 months into the DMP they accepted a 55% F&F
BarclayCardLoan defaulted me straight away and 8 months into the DMP offered me a 45% F&F themselves, didn't even have to ask.
CapitalOne defaulted me straight away and even though I just increased my monthly payment to them they passed me onto a DCA. I requested a CCA and today is teh deadline for this and unless they supply one today it becomes UE and I just continue paying my agreed amount, no worry about court actions here
So you see, its not always doom and gloom on a DMP, everyone is different. BUT I think everyone agrees, the weight lifted of your shoulders about the constant worry how to pay makes you feel so much better.

You could combine them both in one letter if your creditors start calling you a lot.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thank you TakingControl and Tixy just wished i'd done this sooner!0

I've been on my dmp over 3 years now and not been taken to court - I've had threats of it, but that's just it...threats.
Don't wish to scare you but I did have a doorstep collector from Barclaycard who swiftly got told to s*d off. Door stop collectors have not legal rights and you do not have to answer the door to them.
MBNA are my largest creditor and have been brilliant from start. They've still kept interest frozen 3 years on and just write to me once a year saying that they will renew the arrangement as long as I keep up with the original agreed amount. I'm paying more than double the original agreed dmp amount and infact I am paying more than the minimum repayments I would be paying if I was not on a dmp and they've still kept the interest frozen. So I'm making some serious headway into this.
I never heard from Cap One since I started my dmp so assume they've accepted the payments.
Barclaycard were the most troublesome but after they played their games for a few months, they finally accepted.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free

all of mine accepted..at least they know they will get their money eventually..if any of them rang i referred them to payplan who im in a dmp with..
one of my creditors barclays used to ring every so often to see if i wanted to settle the debt with a good percentage knocked off but have never been able to afford it..best thing i ever did going into a dmp..i was defaulting anyway so couldnt make my credit rating any worse.
i did worry at first until they all accepted then the peace of mind of no creditors and no nasty letters was wonderfull.
good luck..0 -
Thanks Deep in Debt and Shellyruby after the initial tears and worry and of course letting my DH know just how bad the debt was, i am feeling more positive. There was no way of carrying on, all the details have been passed onto CCCS and creditor letters sent so know it's a case of waiting and seeing what they say. This forum is great for advice and questions, Good luck to everyone on there debt free journey.0

Hi all just to say DMP in place and all creditors have been wrote to by CCCS with the offer of payment, just heard back from MBNA today happy to accept the amount offered with 0% interest and no charges (So pleased as were really worried about these not accepting) Capital one has defaulted straight away but are accepting the offer, just waiting to see about RBS, Barclaycard and Sainsburys bank now hope these 3 accept as well! Starting to feel happier now

Hi Worried
In case it helps..
sainsbury's accepted my CCCS DMP almost straight away, there were some teething problems with documents not getting to the right department, so I had a lot of phonecalls in the beginning, but they were so kind. Each time they said "what's going on" I'd say "DMP, CCCS, help!" and they'd just tell me nothing had been received, to check with CCCS that it had been sent (and did ask once for it to be sent again) and they'd put me on a no-call list for 10 days. Absolutely no problem with it.
The only thing I'd say, they only signed me up for the payment plan for 9 months, and then I had to go through that process again! And every time I get a statement it always looks like doom & gloom, as it'll say I'm in arrears etc and haven't made a minimum payment (even though it says my min payment is LOWER than the amount paid, don't quite understand!) but they never ever ring to chase.
Can't vouch for RBS exactly, but I have a MINT card which is run by RBS and they accepted everything straight away also. Absolutely no probs with them, all interest frozen.
I've not got a Barclaycard so can't help there.Debt Free and Very Very Proud! - DMP mutual support member 315
