ex partner's bankruptcy

It would be good if he could - the CAB lady advised him to keep deferring, but I doubt if he'll be able to. I'm hopeful that he'll be able to get a job and do the IVA thing. A friend of mine told me that the 5 year cut off was to try and stop couples in trouble putting assets in the wife's name, 'divorcing' and then having the husband go bankrupt, which is clearly not what happened in our case, but does anyone know if this is true?
