Appealing against CSA clerical errors made in 2002 and 2003 – how?

And DLS didn't pick up on this!
Yes, I'm afraid so, but I dont blame him for it because I was none the wiser. I am not critisising him.
If I actually knew where the CSA had gone wrong in the first place, then I could have instructed him properly and appealed the errors on TTW calcs and discover what evidence the CSA relied upon to say I was non-dependent and fail to allow me my housing costs.
The DLS route was takcle the most recent decisions - the deprivation of income, then work backwards. But now I am more informed, the right course of action is tackle the errors first and the deprivation decision can remanin standing. The liability raised would become a nullity (and allowed me to continue my employment).[/0 -
You know your stuff! Thats exactly what I saw. A simple document as you describe. it would have been on the decision notice telling you how they worked out how much you should pay.
However this was never sent to me by post and was only discovered in the DP file much later. see above - part of the calculation that was sent to both you and the PWC
I think it could have been made after the DEO was applied. Therefore is could have been sent to me after I vacated the address when I moved to Zurich.

I'm only a District Nurse with a CSA 'anorak' hobby for the last few years, but I've made it my 'hobby' every waking moment to get to the bottom of CSA law, protect my home and learn CSA tactics etc etc for several years, and seem to know more than a team of people who call themselves CSA experts 'legal at that' and charge per phone call appointment!!
Wow! you should have got a job at the CSA, monetise your interest in CSA matters.
Im not so sure I would make the CSA it my pastime. My feelings at the time was pickup the pieces, move on and re-start family life elsewhere.
It wasnt until I was contacted by Police from the UK asking me to come back and sort out a bailiff that was in their custody suite. I couldnt do anything because he was the CSA's responsibility.
Yopu are right in your analysis, the law has become so mature and complex. Even the governments own experts dont underatand it, and that makes it very expensive for taxpayers (and other liability payers) to comply with it. Out here there is no taxation on income and thus no complicated court & appeals structure. Its a simple way of life and we dont need to count our pennies. We just enjoy life.0 -

It just quoted the two postcodes, employer and home. They are correct.
The £0.00 was not correct and there is nothing about making an appeal. In any event I didnt get the document at the time. The decision/error wasnt discovered until the bailiffs in 2006. I instructed DLS to clear it up and he got the DP file.
I dont have any contact with the PWC and not sure why she would be given information as to my address or employer. That is assuming you are right and PWC received the document.
Would that information be classes as 'personal data' about me in the meaning of Section 1 of the Data Protection Act?
Please dont tell me this opens up yet another enquiry on faulire of duty of care as prescribed under the 1998 DPA.0 -

So, you send in a letter stating 'I wish to appeal against the decision dated XXX which states that I should pay £Y per week on the grounds that the travel to work figure is incorrect. It is incorrect because as the crow flies, from (insert postcode of place of living) to (insert postcode of place of work) it is ZZ miles - which is more than 150 miles. The actual mileage is AAAAA.
My second grounds of appeal are that you have failed to allow my housing costs. I lived in the property alone and the property itself was not owned by any member of my family, nor did any member of the family live in the property. I have already sent a copy of my tenancy agreement which clearly states how much my rent was and this should have been allowed as exempt income. I enclose a copy of the Land Registry document which clearly shows the owner of the property as the landlord.
You then state why the appeal is so late.
You are a devils advocate!! That looks like a good plan. I never thought of getting the Land Registery documents. This is available at the Consular Service here in Abu Dhabi. - But surely the CSA is a government agency and would have checked this becore deciding it was a family property? I told them I was not a non-dependent.
Should I approach DLS or try ICE with my re-tuned approach?0 -
Please don't throw good money after bad with DLS. You are better off on this forum, where you can learn all you need to fight your case, or maybe liase with 'real CSA experts' such as Stephen Lawson, he is not cheap, but is the best in his field!
Pls don't go near Mike and the team at DLS, you really will get more accurate advice on here0 -
Without revealing my personal identity here, I have a feeling I am paid up with DLS and I may be committed by contract which forbids me approaching the CSA directly.
Now I am aware what cards I hold then I think I could have better chances. I am not keen to layout any more money on something the CSA is at fault. If all fails, then I would prefer to put the case up for grabs with the UK media and take the money. If that fails then make we can present a case to the SFO.
If the SFO fails to investigate or tries to cover up the evidence and protect the guilty caseworker then we have corruption enquiry. These always hold better financial returns from the UK media.0 -
Reading your other posts. How long have you been exploring the CSA?
Have you considered setting up a charity? Having charitable status in the Uk has many tax advantages and your knowledge could be put to work providing positive help for vicitims of CSA malfeasance.0 -

I havnt got a problem with Mike at DLS. It could be my own fault for not properly instructing him. I should have been clearer in how to deal with the root cause of the problem.
I was living in Zuruch at the time and I admit, I just handed Mike the whole bundle and told him to go away & sort it. That approach was probably too blas! for instructing a solicitor.0
