Need help and advice

I am having major issues with the people I was renting a flat from here is the email i sent them and their response I am looking to know where I stand legally and what rights I have any questions or further info you need please just ask I am desperate there is no way I can afford a further £800.

My email to them,

To whom it may concern,

Following our telephone conversation yesterday, and numerous telephone conversations since 21st February 2011, where for some reason you state that you never received my notice of termination of contract which I sent Monday 10th January 2011.

I quite clearly stated the reasons for my termination, and have since on numerous occasions told your staff via telephone conversation all the reasons why I no longer felt safe in the property.

The main reason was the constant leak in the bathroom which resulted in me paying excess water charges, after many months the plumber did come out.

The broken window and the front of the property remains dangerous and an eyesore.

I never received an electronic key fob to gain access through the security gate.

The electronic gate constantly broke down either trapping us inside, making us late for work or unable to gain access to our properties at the end of the day, made worse in the snow or wet weather.

This resulted in weeks and weeks of the gates being left open allowing anyone to enter the property and the front door lock to the flats was broken allowing people to sleep rough in the electric cabinet near the side of my front door.

In end of September an unsavory character moved into the block of flats next door, he was a local drug dealer and damaged the electric gate with an electric tool making it beyond repair.

There was constant rubbish around the bins included mattresses and items of furniture, resulting in the refuse collection agents refusing to empty the bins. There was always sights of rats, and on one occasion a rat jumped out of the bins and landed on a refuse collector.

On three separate occasions I found an unknown male rummaging through the bins.

One weekend the police cordoned off all the bins and the flat where the drug dealer was living, he was consequentially arrested for committing a local murder.

The bathroom was an ongoing fight against damp with me having to power bleach the tiles twice a week.

Due to the constant telephone calls repeating the above with different members of your staff, I am requesting that you no longer contact me by telephone and all further communication is made via email or written letter by post to the following addresses, emails to my email address, written letters care of my daughters address. Any further telephone calls will be seen as harassment and may report any calls to the police.

I was happy in the flat until these problems kept mounting, and I no longer felt safe there.

I wish to discuss when I can return my keys (having been told your branch would not accept my keys) and also the return of my bond. As far as I am aware I have followed the correct procedures and cannot understand why you have not received my letter of termination. I moved out of the property on Saturday 12th February 2011.


Their response,

Thank you for your email.

I am sorry to hear about your ordeal with your rental property and will forward your concerns to your Landlady. The tenancy however, is still active as it has not been terminated. We have not received your notice letter. Please could you would forward a copy of the letter or email that was sent informing Your Move of your intention to leave the property, and confirm which date you had intended to vacate.

As it stands, you still hold the keys to the property and are therefore liable for all rental and utility payments, and also the security of the property. I will take your below email as 28 days notice from date of receipt and will terminate your tenancy on the system for 12/05/2011. This will be the date you will need to hand your keys back to your local branch.

The return of your security deposit is subject to your landlords authorisation. A check out will be conducted on the property and we can then ascertain the cost of any damages or dilapidations, which will then be deducted from your security deposit on your Landlords instruction. The arrears showing on your account at present amount to £800, and this will need to be settled urgently.


Where do I go from here thank you. I followed the correct procedure.

    Not a lot you can do then really. Looks like you are probably there until the 12th May. Look on the brightside - thats only just over 3 weeks away now. Unfortunately post does go missing so maybe the agents are being genuine. I would have posted one recorded signed for and emailed another and probably followed it up with a courtesy call.
