Trust Deed/IVA/home Repossesion

Hello,

I was just wondering if anyone can advise me on the below...

I entered into a protected trust deed November 2009. I realise this stays on my credit file for 6 years from the date on entry.

However, I am currently going through a voluntary repossesion on my property. I spoke with my trustee who advised any shortfall would be included within the currect trust deed as it was signed prior to this year.

My question is - Would the repossesion then be added to my credit file when it goes through (2011) and I will have to wait a further 6 years from when they take posession for it to clear from my credit file (2017)? Or would the date be from when the trust deed was signed? To me the date would perhaps be when i started defaulting but im unsure.. Any help would be greatly accepted.

    Not to sure if it is different in Scotland, but normally the shortfall falls into bankruptcy but the date of repossession is the date the property was repossessed and nothing can change that. So although there may be no dispute about the shortfall being included in your trust deed, that doesn't alter the date the repossession took place.

    So are you asking about when the shortfall would be showing as included in the trust deed (which would be the date of the trust deed) or the date of the repossession - which would be the date that the lender took control of the property.

    According to Experian, the date of repossession is shown on your credit report and will stay on for 6 years from date of repossession.
