Can I request this/these default(s) removed?

Options
1) I have a default with CitiGroup. The credit limit on the card was £400 and they have defaulted me at £490. Around £350 of the balance was purchases, the rest is charges and intrest.

Am I able to calim the default is due to charges and therefore have it removed . I have paid them a payment of £300 since the default, so the current balance of the default is £190

2) Also, I have mentioned this before, as well as the default placed by CitiGroup, they have passed the account onto Cabot, this was done just after the £300 payment. They have defaulted for an amount of £190.

Now, I was under the impression that you could only be defaulted on one debt once, or have i misunderstood?

You should only be defaulted the once so you could write to experien, etc and ask for the second to be removed as a duplicate. I've seen it succeed and be turned down. But you won't get the first one off. The best you could do is to pay up and then get it marked as settled.

    Ok, a development,

I have contacted Experian who have said they will look into it as I cannot be defaulted on the same debt twice. They have also adviosed they will note the defaults as being disputed.

I also contacted Cabot/Kings Hill, and advised them that I think they are wrong to place a default on a credit reference as, a) because they have no consent to do so as I have never signed any agreement with them, and b) as this debt has already been defaulted.

    Their response:

'As they are part of CitiGroup, then any consent given to any part of the CitiGroup group is transferrable between them,

    and on the second point.

'When Kings Hill/Cabot are assigned the debt, that effectively constitutes a new agreement, therefore it is proper to default the account'

    Can this be right?
