Urgent advice needed please

    Well they have shafted me! Meant to be paid tomorrow, havent paid me any hols and have made the following deductions £75 for the cost of hiring agency staff, £13.33 for a uniform I never got and £56 for the CRB. Plus there are hours missing. Upshot is I got paid £412 for the whole month :(

    Guess there is nothing I can do other than tribunal? :( I have spent the afternoon trying to reshuffle bills and work out how i can raise the shortfall, I spoke to the owner who said they were very sorry to see me go and i said it didnt feel like they were sorry to see me go, felt more like I had been kicked in the teeth. He said they were well within their rights to charge me for agency staff.
    He knows I have 3 children, how am I meant to survive on that for the whole month. Sorry I am just ranting now, feel really upset :(

    Did you work the week's notice in the end - as if you did, they aren't within their rights to charge for agency staff....
    If you haven't got it - please don't flaunt it. TIA.

    Yes but he still insists it should have been a month :( I never gave him permission at any point to deduct anything from my wages, no contract ever signed. Feel really depressed, I dont know how we will manage this month at all :(

    ring ACAS for some advice tomorrow regarding this.

    then, armed with the advice i would visit your place of work to discuss the shortfalls in your pay.

    let him know you will take it to a tribunal or small claims court, whichever ACAS advise.

    there is a chance that the deductions may re-surface?

    also, as mentioned on another thread - do those deductions take your pay below national minimum wage? it sounds like they have.

    if so, that is illegal and another tack to try x

    Thanks Firesidemaid, I have spoken to ACAS-they said I must issue a complaint in writing to my employer, and then if they do not respond in 7-14 days I can either use their conciliation service or tribunal. I am just gutted they have treated me this way.
    I spoke to the owner and after me making a few revelations he said he will look into it and get back to me today-possiblility of getting something else in around 7 days. I did raise the issues of NMW, breaks and hols.

    Stick a complaint in writing anyway to get the clock ticking,

    This could just be delaying tactics hoping you will give up once started at the new job and getting paid.

    It's dumb business practice to keep on a disgruntled employee during their notice period......

    Give em hell, maybe they'll fire you, in which case they still have to pay your notice! YOU have the strong position here :p
    I'd be giving them soooo much verbal and attitude (in front of other employee's works best).

    i also agree that if you haven't heard anything by tomorrow, give another ring to owner.

    you need that money that is LEGALLY yours by the weekend - if not send your letter of complaint via email, hand and recorded delivery.
