29/4/11 Bank Holiday, Contracted for all B/H but not getting Paid

Hi all, I normally post in “Debt-Free wannabe” as we have money problem but getting loads of advice/help:T
Not sure this is the right place to post but will try.
Myself & my wife are doing all we can to cut back & save, we both work full time, I work an average 45 hours a week in my f/t job, 15-20 hours in my p/t job so a total of a least 60-65 hours a week, my wife is contracted to a 45 hour week but 99% of the time works through her lunch break as it gets very busy in the office so is more like a 50 hour week but only getting paid for 45, we have a large mortgage & 2 Sons so the time we do get off we enjoy.
My wife’s contract is for a 45 hour a week & all Public Bank Holidays but was told last week that they would not get paid for Friday 29th April & was just a normal day, we checked her contract time & time again & she took a copy in to work to prove to other staff that they were intituled to it, thing is everyone is scared to say anything to management as if they have to lay staff off they may go for the one’s they deem “Trouble Makers”, as moneys so tight we cant afford to lose my wife’s job but at the same time she’s working a free day for something she entitled to.

    What is the wording about leave and bank holidays as written on her contract?

    And how long has she been in the job?

    Sorry, I'm not that thick. If your wife already works fulltime and would normally work a Friday, how is she working for free if she works on the 29th? She won't be working for free, she'll just not be getting enhanced pay.

    There is no legal right to bank holidays off nor is there a legal right to be paid any more for them (other than being deducted from Statutory Minimum holiday pay) unless it states so in the contract of employment . FRIDAY 29th IS A PUBLIC HOLIDAY AND NOT A BANK HOLIDAY so if it states Bank Holidays in her contract, then they are correct. You would find that for most people those getting the day off on pay would have it taken from their annual allowance.

    5 years been there & states "All Public Bank Holidays", to be honest I'll think she just go in so not to rock the boat, doubt she is the onlyone with this problem in Britain.

    IT IS NOT A PUBLIC BANK HOLIDAY. It is a Public Holiday. The two are not the same thing. One is a holiday that was traditionally given to bank workers hence the name bank holiday, the other is a holiday given to the public by the government to commemorate a special occasion. Therefore her employer is correct and not in breach of contract as it is not a bank holiday.

    It is a BANK hoilday, not a PUBLIC holiday

    It has been announced that there will be a special bank holiday in 2011 to celebrate the royal wedding and in 2012 to celebrate the Queen’s Diamond Jubilee

    In that case if she is paid bank holidays IN ADDITION to statutory holiday, she is entitled.
