Hi , my wife has a few loans with these people who took over the original loan company last year.
We are currently unable to pay more than £1.00 / month on each account due to long term illness but after a telephone call she received this week they are wanting full payments or they will start legal proceedings.
If i sent them a CCA request and they could not produce a true signed copy of the agreements would they still be able to go to court with these debts as i had a similar issue with Link financial who also couldn't send me a signed copy but they took us to court and the Judge felt that even without the Agreement they could continue the claim and have now got a charging order on my property.
Does she also just send them the minimum £1.00 payment regardless or should we wait for the CCA request response if i am advised to send the request.
We are unable to pay the mortgage at present and i am sure to be in court again about the repossession of the home.

What sort of loans were they? When were the loans taken out?
They do not have to supply you with a signed copy of the agreement but should be able to provide you with a true copy - that is a copy of the agreement that you would have received.
If you are in arrears with your mortgage have you sought any advice from one of the debt charities?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
