Council tax band issue

The flat I am in at the moment (rented) is supposedly Band C however all the properties around it are in Band B (and my flat is probably smaller than all the others - 1 bedroom). My first issue is should I go ahead and try and get it rebanded as I am not sure how this will effect things for my landlord? I have been in the flat for a good few years (and have paid my council tax promptly etc) - would I get a rebate potentially?
Debt at worst: £33000 (Feb 2011). Present debt: £25610 (Apr 2012)
Lloyds old (22.4%) = 560 (Dec 2012)

It won't affect your landlord as you pay the CT, not the LL. The worst that could happen would be that your band is correct, but the Band B flats are incorrect.

As you are supposed to pay your CT promptly, the fact that you have done so has no effect on the rebanding process. If you did get a reduction and you were in arrears with CT payments, any refund would be used to bring your CT account into credit, any surplus would either be refunded or credited against the CT account for the remainder of the year.

Ok. Thanks lincroft1710. I'm not sure if I'll have much success claiming anyway as I have lived in the property for over 6 months (didn't know about the 6 month rule). I'll go ahead and try anyway.

The 6 months time limit only means you cannot have the matter determined by the (independent) Valuation Tribunal if your request for a re-banding is refused. If the band is wrong then it should be corrected whether you've lived in the flat 6 weeks or 16 years.
