Debt letters arriving 2 YEARS AFTER MY B/R????

Hi All
I have been trying for over 10 months to clean my credit files after my B/R in Nov 2009!! However I now find that I am receiving debt letters demanding that I pay - ??? These debts were included in my B/R and provable. I have followed the advice on here and sent letters to 4 companies and also sent letters before action to them and they just WON'T amend my credit files!!! I have also had my O/R write to these companies and STILL they are not amending my files. 4 Companies have balances outstanding and these were all included in my B/R. I have followed the advice from Equifax and Experian and they too have wriiten to these companies. They have been sent PROOF of my B/R and DISCHARGE and still nothing. Could anyone advice me what to do now as this has been going back and forth for several months now and I want my credit files corrected. I have sent everything recorded delivery and have even sent proof of them signing for the letters!! Now I am in a position whereby other DCA'S are trying to extract money from me when these debts WERE included in my B/R and they have ALL been sent PROOF!!
Please where do I go from here as I feel as though I am banging my head against a brick wall and getting nowhere.:mad: Thank you

    Santander I presume is one?

    They are being a pain in the bum with bankruptcy records, defaults, and all sorts of incorrect information on peoples files at the moment. Not just people who have gone BR, so you are in plenty of company.

    Anyway, let me know who the original creditors who aren't updating are?

    Plus who the DCAs chasing are?

    The DCAs can probably be warned off quite rapidly.

    The original creditors may merit on last try at getting them to comply, or it may be time to make formal complaints through the ICO and FOS.

    I was made Br in Nov 09 as well, but so far have not had anybody chase me, my OH has had Sky try it but so far we have heard no more after threatening them. I would do as fermi suggests and report them to the relevant authorities. Or let them take you to court along with a caopy of all your corespondence and let the judge deal with them :rotfl:

    Thanks again for helping me. The creditors who are refusing to correct my files are 1) Santander - My bank account I had to surrender to my O/R, which was in credit and since is showing default and a figure of £113.00 ( Obviously charges applied to the account when I surrended it- cards cut up etc!!)
    2) Vanquis Bank - 2 Accounts (again both cards cut up and surrended to my O/R)
    3) Hillesden Securities - Welcome finance - Was a joint account with my ex hubs who left in 2002!! This is in my married name, they have 2 entries on my credit files - one in my married name and one in my maiden name that I have used from 2004 - both accounts for the same debt, one marked as settled, the other still outstanding!! (A notice of correction was applied on my files, to inform of my divorce and no financial link with hubs!)
    I have written to all these people, followed by LBAction letters , copies of THEIR signatures sent back to them all. I have practically begged Experian and Equifax to assist me as I am getting nowhere with these companies.
    I have just checked my credit files again an hour ago and the DCA that is hounding me MUST be acting illegally, as the account is showing as settled on my files??? Why is this happening??
    DCA is Advance Investigation Services - Notice of Intended Visit - blah blah.....

    I am so frustrated that no one is correcting all this wrong information about me on my credit files, as I said I have complied with everything I have been asked to send/prove/etc and I am getting nowhere. This MUST be illegal entries??? Surely something can be done?? But I have exhausted every avenue now. Thanks again for any help / advice.

    1) Santander may be worth emailing a copy of your previous letter/documents to [EMAIL="complaints@santander.co.uk"]complaints@santander.co.uk[/EMAIL]

    I don't hold out much luck though, as Santander are complete tits!

    Probably time to start off the complaints to the ICO and FOS though as well.

    2) Vanquis - Did you get a response from them?

    Maybe complain again to:

    Vanquis Visa Card,
    Customer Service,
    P.O. Box 399,
    CHATHAM
    ME4 4WQ

    But again, perhaps time to put in formal complaints to the ICO/FOS.

    3) Same as above ^^^

    If the debt is still mowed by your OH though, the ICO may not say "technically" it is settled. Can be a pain with joint accounts. Worth a further complaint though.

  • DCA is chasing a different debt to the above list....a catalogue debt! this does say settled on my files so why are they chasing me for this??? I am not overly concerned about this, but I feel that this is illegal to be chasing me for debts that were included in my B/R and provable!! They can go forth for me!! It makes me so damn mad, if I was not clued up I could have panicked and tried to repay stuff - these Companies that try and prey on the vulnerable people make my blood boil!! Rant over!!

    Vanquis have NEVER responded to any letters/complaints etc.

    I understand about my ex - OH, but I am hoping that my C/Files will be able to adjust this....with a nice worded letter!

    So I need to be writing to ICO/FOS now?

    Santander - its just a joke, anyone can clearly see from my C/Files that my account was running ok, years of nice green ticks/boxes and then in Nov 08, started to go red!! (Err just at the time I handed the account/cards to my O/R!!) so the default is THEIR doing and they want me to pay £113.00 charges....my account was in CREDIT when handed over not DEBIT -again all this is provable!!

    Its beginning to get on my t**ts now all this complaining..... all I want is my credit files to be corrected!!! I followed the Law to the letter when I went B/R in 2008 - 2009, did as I was told/instructed...handed and cut up all cards/accounts as instructed.....waited to be disharged....waited a further year to clean my credit files up...and now all this......

    Totally Frustrated Sugar....sigh.............

  • Oh and ALL these companies have the INCORRECT DATES - some have them AFTER my B/R.....Something else that I have been fighting them with.....

    Yes. Complain to the ICO.

    And if it's been more than 8 weeks since you initially complained to the creditor, then complain through the FOS as well if they will accept the complaint.

    Ate the same time, you can fire off one last complaint to the creditors via email or snail-mail. You never know, they might pay attention this time?

    For some reason you seem to have got a bad bunch. :(

    The DCA can just be sent the "**** off as this is covered by my bankruptcy" letter.

    Have you got a copy of that?
