Letter from Moorcroft Debt Recovery

Hi, have received a letter from Moorcroft regarding a recently defaulted debt, and was hoping to get your take on it ...

"We have been instructed by BOS to collect your over due debt of £xxxxx

It is a legal requirement to send a notice of intended litigation before legal proceedings in the County Court are issued."

Does this mean they are about to start the process to get a CCJ, or are they just making threats?

I have already written to BOS offering token payments as I am on JSA, and intend to write the same letter to the above organisation. Surely getting a CCJ will be a waste of time as the court will ask me to pay the same anyway??

    They send that letter to virtually everyone. Just a standard threat letter.

    The chances of them actually taking court action are very small.

    I meant to add....

    Keep making the token payment offers in writing, making it clear that you are only on JSA.

    If they are daft enough to go to court then you can show you have acted in good faith.

    You are doing the correct things already with the token payments and keeping records.

    If they start to get difficult by either telephone/letter just come back on and people will point you in the direction of the standard letters and the Government organisations to whom you can seek redress for any harrassment.

    Remember- you can only pay what you can afford! Good luck.
    Debt now £48,000 in the form of a mortgage :o

    thanks all, I was curious whether they were notifying me that I was going to be getting papers from a court or not. My expectation is that they will bluff for a while before agreeing to token payments until I can afford more.

    Out of interest, how long will BOS typically wait before selling the debt onto a 3rd party debt collection agency? The default only occurred in the last month or so. Does it largely depend on how long it takes before I am able to start making regular contributions to settling the debt?
