These called my house today looking for my brother.

He does not live at the house and never has done and they questioned my 15 year old over the phone.

Are they allowed to make unsolicited calls to an ex-directory number?
I can guarantee my brother never gave out our number where did they get it from?
Can they ask a 15 year old whether he lives here? Where he is? etc etc?

    telephone number: _____________

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls despite confirming repeatedly that I am not the person whom you seek. (Delete if necessary) I have reported this matter to the OFT, as examples of unfair practices are as follows:
    f .pursuing third parties for payment when they are not liable
    (OFT 2003 guidelines)


    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    I would not even provide them with my name/address to be honest as they are not to be trusted with personal details.

    Well, I'm sure they didn't know they were speaking to a 15 year old when they called.

    No need for letters, the above is pretty pointless. And you certainly don't need them to write to you, because the debt isn't yours.

    However, if they call back, all you need to tell them is that your brother does not live at your address and never has. You can either tell them where he lives or tell them you don't know where he is, it's up to you. Then tell them that if they don't remove this number from their records immediately you will report them to the OFT, Trading Standards and OFCOM, and simply hang up.
