I am being told 1 thing by work and something else by friends so I am just wondering if anyone can help clear this up for me.
I started maternity leave from work on the 22nd June 2009 - I used all of my holidays before I started my mat leave and at the time had been told that I would just lose the Bank and Public Holidays while I was on Mat leave - all I would get was maternity pay. I have since been told by a friend who works in HR that these days should either have been added to my holiday entitlement before mat leave or I should have been paid in full for them (not at maternity pay rate). Work dispute this.
Now that I am back at work I do 4 days - Monday-Thursday. Should I get anything for the Bank and Public holidays I miss on a Friday - e.g the Royal Wedding, Good Friday?
Can anyone help?

you should get as a total 5.6 weeks of holiday times 4/5ths which is 22.4 days total if you recieve stat minimum. Bank holidays can be included in this figure.
How many days do you recieve including bank holidays?The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

If my contract says 25 days + B&P Hols should I have been paid in full or given the option of taking them when I was on mat leave? Or are they right that I just lost thes days and got paid mat pay?

If it's 25+8 for everyone else, then as a part-timer you're entitled to the same, pro rata. Which means you're entitled to four fifths of 25+8, which is 26.4 TOTAL LEAVE days.
Obviously on BHs, you have to take those as leave. But the rest is yours to take as AL. They can't say you're entitled to all the non-Friday BHs, otherwise any PT-er not working on Monday would significantly lose out. You have to look at your total leave (AL + BH) entitlement and take BHs out of that, depending when you work.If my contract says 25 days + B&P Hols should I have been paid in full or given the option of taking them when I was on mat leave? Again, you are entitled to 28 days fully PAID leave a year. Given that yours is 33 paid days, then I would say you're entitled to those (the extras that you didn't take) on full pay, yes. You got the AL element on full pay, so I don't see why you wouldn't get the BH element on full pay, too, otherwise someone with the basic leave rights on SMP wouldn't get the legal minimum.

Many thanks for the help - I just want to make sure that I am getting what I am entitled to in terms of when I was on mat leave more than anything else.
I think I might go to CAB and see if they think I should push for the BH's I missed out on when I was on mat leave - its only a few days but they would come in handy. There are very few people in my office who are part time so I don't think that our HR dept have had to deal with this before and might be unsure of what they should be doing.

The thing to remember about part-time work is that you have exactly the same T&Cs, simply pro-ratad. Hence your BH entitlement should pro-ratad, not only applied if you happen to work on a BH.
