Nursery trying to claim I have not paid

    Could you sign up for online banking and see if you can print/screen cap the relevant dates out? That would be free.

    Just a quick update, I have talked to her solicitor this morning who state that the information they received from the nursery shows an out standing balance of £450. I have given him payment details and the date when I made the payment and informed invited him to take me to court where I would defend my case in its entirety, due to having the evidence in black and white. I have print outs of my bank accounts for the months where the transactions happened. His reply was that he would talk to his client and ask for them to double check that the payment hit her account (it did I even confirmed this with her). And should this be the case that she should issue an apology.

    After digging around, it seems that the nursery closed early this year and the owner is trying to "sting" loads of parents for money. Maybe a little letter of complaint to the local paper is in order?

    Perhaps, but might it not be more effective if you were to pop in to the local council offices and have a word with the wallahs and wallahesses of the Trading Standards department?

    Yes, but expect the response of "It's a civil matter, sir." as the lazy lunkheads will not really want to investigate.

    Fraud is fraud, she tried to obtain money that wasn't owed. And if anyone has paid up based on the threat from her solicitor, then the Police should be informed.

    She's a chancer and needs taking down a peg or two.

    Im not concerned with my own battle with her as such, I have all the proof needed that I cleared my account and paid up. The rationale for making a letter of complaint in the local paper would be to raise the matter with other parents having a battle with her as well.

    Agreed. Some people may get lower "bills" and may think "I better pay" - much along the lines of how those parking companies/debt chasers that send out mass letters work, some people pay otherwise they would be out of business. Come to think of it; lots of people fall for Nigerian scams so some poor git might fall for this.

    Perhaps you should ring the solicitors with your findings and suggest they might wish to cease working with her, lest you pass your info onto "the bar" (is that the right term?)

    The Bar Council only applies to barristers; solicitors belong to the Law Society - and I rather doubt that the Solicitors Regulatory Authority would be much interested in this case.
