  • Just to add in another post you clearly state you went BR as your father refused to help you further even though he had the financial capacity to do so , so why did you need to give him money for a wheel chair.
    Im not tricking you but if you are not clear and consisent in your answers then you are going to open up a can of worms as im sure the OR will take a good look at your history.

    You need to discuss the possible tribunal with the examiner, the link that debtinfo has posted above relate to this.

    Otherwise, the OR will not rule your everyday day.

    Just in case... i have been told by the human rights and equality commission to file a claim for:-

    their not making adjustments for my disability
    disability discrimination
    victimisation
    harassment

    (i was there for 9 years.)

    The above all relate to what happened whilst i was employed and during the redundancy process. Can the OR really tell me to stop when I am representing myself and related to things that happened before the BR and was instigated six months prior to the BR??

    You have to view this from the OR's perspective

    What happens if you lose your case (and I think it's about 1% of constructive dismissal cases that are won by the employee), and costs are awarded against you? You could be increasing the amount of debt considerably.

    But talk it over with the examiner first, I suspect they will need to discuss further so you might not get an answer during the interview.

    Whilst they might not tell you how to wipe your backside, they might question your use of luxury loo paper or, conversely, the Daily Mail if used solely for that purpose. :p

    If the Human Rights and Equality Commission want you to file a claim, why are they letting you represent yourself? Would they not be more likely to win a test case if they funded the case?

    [flyright] As a bankrupt you cannot pursue any such claims as all rights of action now vest in the OR
    [debtinfo] really, are you sure that ALL rights of action vest in the OR, thats a very sweeping statement
    [flyright] Yes, fair point..but the action here should be disclosed to the OR so that a decision can be taken as to whether the rights do vest.

    Debtinfo is speaking to flyright here, not suggesting that all rights of action do vest in the OR.


    (Not helpful when someone has aspergers, really i wish people would be more aware of this sort of thing :( )

    I would definitely advise speaking to ACAS about your Tribunal. They may be able to mediate a settlement for you before it gets to the Tribunal date, they did for me a number of years ago and I got exactly the amount I was underpaid too.

    I have not taken the time to read all of this thread as my mind boggles!

    As I understand things any money you receive whilst BR MUST be reported to the OR who will decide if it is yours to keep or not. Forgive me for not reading the post in full but why are you claiming against your ex employer? Have they not given you redundancy money which you have already spent? We are in a recession so companies are cutting back, how many people were made redundant in the company? and why? If a company can no longer afford to keep employees on board then I am afraid they have to let position go (it is not the person who is made redundant it is the position)

    I do not mean to be harsh but are you just after clearing your debts via BR and keeping any future windfall for yourself?
