need help with Cap quest!!!!

Hi,
I was wondering if anyone could help me out with Crap quest and whether or not to take them serisoulely.
I have a Vodafone debt from 2009 that they are claiming i owe them for which is for £938, this week i received a letter in the post saying that they had served a statuary demand on me and if did not apply to set this aside or settle the amount with them in full then they would make me bankrupt is this just another scare tactic or should i take notice of this ?
I phoned them up querying the debt and advising that i could not pay that amount off , they tried to push me into a payment plan and asked me loads of personal questions such as where i work and what my monthly income is and what all my outgoings are? they then wanted to set up a direct debit over the phone with me however i was not comfortable giving such information over the phone to them, does anyone know if do have to pay this debt to them are they able to send out a direct debt mandate?
I would rather not have to pay for this ridiculous debt to them, as my Vodafone contract was cancelled by Vodafone themselves as i was unable to pay an outstanding balance of £100 to them even though i phoned them numerous times to explain that i had lost my job and could not afford to pay this and i would be willing to pay monthly instalments if they were willing to replace my SIM Card that had been damaged to which they refused.
The letter that Crap Quest have sent sounds and looks very formal and serious and i am unsure of what to do now, any help or advice would be much appreciated.
P.s i have noticed allot of people saying to ask for the credit agreement has proof ? how likely is it that they will have this ?

Hi
If you are arranging to pay I wouldn't set up a direct debit with them. Its better to set up a standing order so you can control how much you pay and if you need to alter the amount. With a DD debt collections agencies have been known to take more than agreed and claim you agreed to it on the phone.
You cannot ask for a credit agreement for a mobile phone debt (these are service agreements and nt covered by the consumer credit act).
First I would write to them with a copy of the prove it letter - see here - and ask them to prove you owe the money and that the balance is correct. When sending a prove it letter its worth sending it recorded deliv and don't sign your letter just print your name.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thank you for your reply Tixy,
That is the exact reason i did not want to give them my details for a direct debit over the phone and if i do decide to pay i will go ahead with a standing order.
How do i know if this threat is seriouse or not? have you heard of anyone been taken to court by Capquest and made bankrupt ?
What would they they need to send me to prove it?0 -

The friend I am helping has had 2 one 4 years ago and one 1 1/2 years ago one for 5 k the other foR 1 k I think the advise on here was if cpaquest were going to make him bankrupt let them as he had no assets etc and couldnt afford to pay to go bankrupt and it would have permitted him to add all the other debts on to the BKP and capquest could not guarantee they would get any more than anyone else ...never heard from them again apart from out of the blue phone call but changed number to get rid of that hassle.0

Thing is this ultimately rubs off on Vodaphones reputation. Shocking that they are threatening bankruptcy on such an amount.
Is the balance correct?, seems a huge amount for a phone bill and we all know DCA's like to add phantom charges.0 -
