Hello from a newbie and Uber thanks!

Hi There

I have been lurking for the past couple of weeks on this board so thought i'd pop up and say hello :wave:. I was advised by the CCCS, that bankruptcy via the LILA route ( i live in Scotland) is my best option.

I have downloaded the forms, now just have to do the task of filling them in and sending them off. I have accumulated £13,000 and have struggled for years to try and pay it off, but to no avail. I am scared and anxious but no longer to the extent i was.

Finally, i can see a light at the end of the tunnel. I certainly am not pleased i am in this situation, however i am getting over the ashamed, depressed and embarrassed emotions of it all. I am now in practical mode to deal with this once and for all.

I cannot work due to ill health and live with my parents. However, i am moving in with my amazing and supportive partner within the next few months. I will also be starting a college course which leads onto a degree to try and better myself. With starting to finally deal with my debts also and not stick my head in the sand which i have been doing for months now, i have hope. You know that sinking, sickly and anxious feeling at the pit of your stomach whenever you think about the debt well it is finally starting to lift.

Whilst i know it is in no way going to be easy, thanks to all the information from here accumulated by you amazing people (on the bankruptcy in scotland threads aswell) i now have hope for a decent, happy and debt free future.

So, i am sure you may have heard a lot of this time and time again but really a great big thank-you to those that dedicate their time to posting and helping others on here. :T You have no idea how much it has helped me and many others.

I hope to post now and again and be less of a lurker in here :D

    hi there.

    im also a single mother with 2 kids and im about to go down the LILA route too! I have the wonderful job of compiling all the figures for the debts this next week. im dreading it coz it will have grown from the last time my solicitor and i went through everything last year.

    it really is a relief once you have made a firm decision. my oh has been wonderful about it all and i was scared and embarassed to tell him about it in the first place.

  • I work in the insolvency business as a debt adviser and I get a great deal of pleasure from being able to provide information to the people who contact me and make them aware that despite the endless letters and calls from their creditors or outside agencies to recover the debt, they have got options and choices available to them.

    Giving good impartial and free debt advice is what it should be about and there are a lot of people only too willing to try and get you to part with money for help that is totally unneccessary.

    The laws in Scotland regarding debt are very different than to the rest of the UK and this is not a well known fact.

    I would always suggest that despite the fact it`s not a comfortable discussion to get in to, to seek advice from a number of different people in the insolvency business from advisers to CAB or the AIB and if they are all singing from the same hymn sheet then you can be assured it is the right way forward for you.

    Please bear in mind that there was new legislation introduced in Scotland on the 15th November 2010 called `certificate of sequestration` which is a new route into bankruptcy.
    This will allow people who previously had no route into bankruptcy with a viable solution.
